Does Ordain:
An ordinance amending the Zoning Code,
Chapters 60 to 64 inclusive of the Saint
Paul Legislative Code, as amended, per-
taining to Use Districts, Heights Districts,
and Rezoning of certain properties in the
City of Saint Paul, This is an emergency
ordinance rendered necessary for the preser-
vation of the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. TYet the Zoning Code, Chapters 60 to 64
inclusive of the Saint Paul Legislative Code, as amended,
pertaining to Use Districts, Height Districts, and
Rezoning of certain properties in the City of Saint Paul,
be and the same is hereby further amended so as to
rezone the following described property from "A" Residence
District to Commercial District:
Lots'-8 and 9, Block 1, Clifton. -Dale
addition, according to the plat
thereof on file and of record in
the office of the Register of
Deeds in and for Ramsey County,
Minnesota, located on the south
side of Larpenteur Avenue between
Lexington Avenue and Dunlap Street.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preser-
vation of the public peace, health and safety. ''
Section 3. This ordinance shall take effect and be,
in force upon its passage, approval and publication.

St. Paul Legislative Code, re Zoning,
m etc., be amended so as to rezone prop-
erty described. as, Lots 8 and 9, Block

This is in the matter-of-the petition -of .Katherine H. Pepin to rezone from
"A" residence;to commercial certain property located on the south side of
Larpenteur Avenue between Lexington Avenue and Dunlap Street. The property
is described as Lots 8 and 9, Block 1, Cliftondale Addition. The zoning is '
"All residence and has-been since the adoption of the Ordinance in 1922.
In a letter dated November 10, 1959, "the Commissioner of Finance reported
the petition sufficient with 14 of a possible 14 (100%) owners of property
within the prescribed 100 foot radius of the property under consideration
having signed the petition. -. The petitioner is the owner of the entire
street frontage of the property under consideration.
The site is presently vacant and the applicant proposes to construct a one- .
story contemporary dental clinic building which will provide office space '
for two doctors of dental surgery. This property' has'a frontage of 80 feet
along Larpenteur Avenue and extends to'a depth of 125.5 feet, resulting in
a total area „of approximately 10,040 square feet.
North across Larpenteur Avenue is the Roseville Shopping Center; south and
across'an alley are single - family residences fronting along California
Avenue; east and'adjoining'is'a recently constructed doctor's office building
fronting on Larpenteur Avenue; west and adjacent is vacant land.
Field investigation discloses no objection `to this use as it will further
provide a very satisfactory buffer use betweenithe'Roseville Shopping Center
across Larpenteur Avenue to the north, and the Single family residences
across the alley to the south. The preliminary land use guide plan desig-
nates this block fronting on Larpenteur Avenue to be in a commercial district.
The proposed use would be one of the most desirable types of commercial use
where commercial zoning abutts a residence district, and it would not be
detrimental to the adjoining residential properties to the south.
In consideration.of the above factors, the Board of ?oning recommends the
granting of the petition to rezone the above described property from "A”
residence to commercial in accordance with the proposed plan of development
submitted on November 23, 1959.
