THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64
inclusive of the Saint Paul Legislative Code, as amended, per -
taining•to Use Districts, Height Districts, and Rezoning of
certain properties in the City of Saint Paul be and the same is
hereby further amended so as to rezone the following described
property from "B" Residence District to "C" Residence District:
Lot's nl, 2 and 3, McMenemy's Subdivision A,
situated at the southwest corner. -of Magnolia
Avenue and Westminster Street, according
to the plat thereof on file and of record
in the office of the Register of Deeds in
and for Ramsey County, Minnesota.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health-and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.

Dear Sir;
This is in the matter'oi the application of "Eunice Friberg to rezone from "Bit
to RCR Residence'certain•property located at the southwest corner of Magnolia
and Westminister. The property is described as Lots 1, 21 3, McMenemy's Sub A.
The tract is zoned KBn Residence and has been since the adoption of the Zoning
Ordinance in 1922.
On October 22, 19592 the Commissioner of Finance reported the petition suffi-
cient with 12 of a possible 16 owners (75 %) within the prescribed 100 foot
radius having signed the petition. The'petitioner ovu s 100% of the frontage
of the property requested to be rezoned. This property is presently vacant
and the applicant proposes to develop the site for multi- family residential use.
It should be noted that the applicant has not submitted plans as to the size of
building and site layout and arrangement if the property is reclassified. This
tract has a frontage of 117 feet on Magnolia and 123.15 feet on Westminister,
resulting in an area of approximately 14,408 square.feet.
South and across'a plated alley are two single - family residences fronting on
Westminister 'Street,•' •east •and 'across Westminister 'is a'duplex" which fronts on
Magnolia Avenue, farther to the east are single and two - family residences;
d'iagonally•aoross the intersection of Magnolia Avenue and Westminister Street is
a single family residence; north and cross Magnolia are single two -family
residences and another structure which appears to be a multi- family'residence'; '
west and adjoining are two single - family residences fronting on Magnolia Avenue.
Field investigation'4iscloses that this property is level, maintaining approxi-
mately the same grade;ta:w Westminister Street. However, due to the steep grade
of-Magnolia Avenue the property lies approximately 5 feet above that street
grade at the west lot line. The area is substantially developed with single
and two - family 'residences which•are of an older type but which are in a good
state of repair. It is the opinion of the Board and its staff that this property
should be developed in keeping with the single and two - family residential
character of the neighborhood.
The Board feels that the development of this property as a multi - family use may 1'
be detrimental to the adjoining properties and will deviate substantially from f
the purpose and intent of the Ordinance. The Land Use Guide Plan indicates that
this area should remain as a single and two - family residential neighborhood. To
rezone this property to "Cn Residence would constitute "spot" zoning.
