December 3, 1959 Mr, Joseph Okoneski - City Clerk Building Dear Sir: This is in the matter of the appeal of the Ave Maria Home to establish a Boarding and Care Home for the Aged on property located on the southeast corner of Cherry Street and Maria Avenue. The property is described as _ Lots 7 through 9, Block 10, Suburban Hills. On October 1st, 1959, this property was rezoned from "B" residence to "C" residence for the_purpose of establish such' a use. ` This appeal is brought before the Council pursuant to Chapter 60.15 of the St. Paul Legislative Zoning Code which states : "... hospitals, homes for the aged, rest homes, convalescent homes, and establishment or places of any kind or character, where old, infirm, sick or diseased persons are cared for, shall be permitted only in districts classified as "C" residence, or lower; and the same shall not be permitted in "C" residence districts unless a public bearing is held as per to determine the necessity and con= venience to the community, and whether it will be detrimental to the health, safety, order, convenience, prosperity and general welfare of such district." As pointed out in the September 30, 1959, letter to the Council relative to the rezoning of the property under consideration, the Board of Zoning reported that field investigation disclosed no basic objections to the proposed use, and that the use is of a semi - public character similar to semi- public and public uses which are permitted in 11A7, "B" and "C ". residence districts. The Board of Zoning feels that the proposed use would serve as a convenience to the community and that it will not be detrimental to the health, safety, order, prosperity and general welfare of the-area. In consideration of the above factors, the Board of Zoning recommends that the appeal of the Ave Maria Home for a permit to establish and Boarding and Care Home for the Aged on the above described property be granted.
