Dear Sir:
This is in the matter of the appeal of the Ave Maria Home to establish a
Boarding and Care Home for the Aged on property located on the southeast
corner of Cherry Street and Maria Avenue. The property is described as _
Lots 7 through 9, Block 10, Suburban Hills. On October 1st, 1959, this
property was rezoned from "B" residence to "C" residence for the_purpose
of establish such' a use. `
This appeal is brought before the Council pursuant to Chapter 60.15 of the
St. Paul Legislative Zoning Code which states : "... hospitals, homes for the
aged, rest homes, convalescent homes, and establishment or places of any
kind or character, where old, infirm, sick or diseased persons are cared
for, shall be permitted only in districts classified as "C" residence, or
lower; and the same shall not be permitted in "C" residence districts
unless a public bearing is held as per to determine the necessity and con=
venience to the community, and whether it will be detrimental to the health,
safety, order, convenience, prosperity and general welfare of such district."
As pointed out in the September 30, 1959, letter to the Council relative to
the rezoning of the property under consideration, the Board of Zoning reported
that field investigation disclosed no basic objections to the proposed use,
and that the use is of a semi - public character similar to semi- public and
public uses which are permitted in 11A7, "B" and "C ". residence districts.
The Board of Zoning feels that the proposed use would serve as a convenience
to the community and that it will not be detrimental to the health, safety,
order, prosperity and general welfare of the-area.
In consideration of the above factors, the Board of Zoning recommends that
the appeal of the Ave Maria Home for a permit to establish and Boarding and
Care Home for the Aged on the above described property be granted.

Home, 170 Maria Avenue, be rezoned from Class "B" to Class
"Cn
The purpose in asking-for such-rezoriing is to change the
operation from d Rooming and Boarding Home for the Aged
to a Boarding and Care Home for the Aged.
This change of operation is being made in cooperation
with'the_Minnesota Department of Health.' It will enable
us to' provide more -adequate'service for the aged. We
shall of'-dourse, make any structual changes -and' instal -
latiofis-re4uested by the City and State Health Departments,
the`'City'Architect, the State Fire Marshal and the City
Fire Prevention Bureau.
This corporation-is the contract purchaser of Lots 1 thru
9, Block 10, Suburban Hills from the Discalced Carmelite
Ave Maria Home

Nuns of St. Paul. However, it is our'-intention to ask
for rezoning for only Lots 7, 8, and 9.
Petitions signed by a sufficient number of neighborhood
property owners are enclosed. A check for $40 for the

It will be greatly appreciated -if the Zoning Board and
City Council will-'give this request consideration at the
earliest convenient date.
