WFIEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two-story, wood frame single family dwelling and its two-stail gazage located
on property hereinafter referred to as the "Subj ect Property" and commonly known as 1681
REANEY AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on ar before March 2, 2009, the
following are the now known interested or responsible parties for the Subject Property: Victor E
Ikani, 1681 Reaney Avenue, St Paul, MN 55106; Laurel B Igbanugo, 17865 Formosa Avenue,
Lakeville, MN 55044; JP Morgan Chase Bank NA, 200 White Clay Center Drive, Newazk, DE
19711, Peterson, Pram & Bergman, PA, 55 Fifth Street, #800, St Paul, MN 55101; Vicki
Rhodus, 800 Brooksedge Blvd, Westerville, OH 43081; Safeguazd Properties, 650 Safeguard
Plaza, Brooklyn Heights, OH 44131; District 2 Community Council Greater East Side.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul L,egislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated July 17, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WIIEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by August 17, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings, and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, October 27, 2009 to hear testimony and evidence, and after receiving
tesrimony and evidence, made the recommendation to approve the request to order the interested

this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the strucrixre in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WIIEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday,
November 18, 2009 and the testimony and evidence including the action taken by the
Legislative Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1681 REANEY AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Aousing or Building code
violarions at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then laiown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspecrions, Vacant/Nuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The
��l�e� demolition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
2. If the above corrective acrion is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The buiiding is a two story, wood frame, single-family dwelling with a detached t�vo-stail garage
on a lot of 9,583 square feet.
According to our files, it has been a vacant building since November 25, 2008.
The current property owner is Victor E Ikani, per Ramsey County Tax Records.
There have been two (2) SUMMARY ABATEMENT NOTICES since 2008.
There have been four (4) WORK ORDER(S) issued far:
- Improperly stored refuse, garbage and misc debris
- Boarding/securing
- Removal of tall grass and weeds
- Removal of snow and ice
On June 2, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on July 17, 2009 with a compliance date of
August 17, 2009. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (Assessed on 3-27-09)

Dear Sir or Madam:
The VacanUNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
1681 REANEY AVE
and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On June 02, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of detciencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shail
not again be used far occupancy until such time as a Certi£cate of Compliance or a

;es or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a two-story, wood frame single family dwelling and its two-stall garage.
1. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
2. The exterior walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
4. The exteriar walls of the house and/or garage are defective. Repair all holes,
breaks, loose ar rotting siding, to a professional state of maintenance.
The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
6. The windows and/ar storm windows aze in a state of disrepair. Replace all
missing ar broken window glass. Make all necessary repairs to frames,
sashes, hardwaze and associated trim in a professional manner. Permit may be
required.
Lack of Water Service. Immediately restore water service. Failure to provide
water service will result in these premises being declued Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
8. The interiar ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
9. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
10. SAI�IITATION: Immediately remove improperly stared or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, tires, etc., from yard.
The Saint Paul Legislative Code requires all exterior property areas to be
maintained in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not conected by August 17, 2009 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs wi11 be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Deparhnent of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC Teview and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to a11 interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enfarcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accardance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Athena Elias, attomey with Usset, Weingarden & Liebo, appeazed on behalf of JP Morgan Chase
Bank. Luke Schneider, Safeguard Properties, also appeared on behalf of JP Morgan Chase Bank.
Ms. Elias stated that the bank was not currently in possession of the property and explained that the
law firm of Peterson Fram & Bergnan had been assigned to handle the foreclosure proceedings and
she was unsure when the redemption period would expire.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two
story, wood frame, single-family dwelling with a detached two-stall garage on a lot of 9,583 squaze
feet and had been vacant since November 25, 2008. The property owner of record per Ramsey
County Taacation was Victor Ikani. A code compliance inspection had not been done, the vacant
building registration fees in the amount of $1,000 went to assessment on March 27, 2009, and the
$5,000 performance bond had not been posted. On June 2, 2009, an inspection of the building was
done and a list of deficiencies which constitute a nuisance condition was developed. An order to
abate a nuisance building was posted on July 17, 2009 with a compliance date of August 17, 2009.
To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taacation estimated the market value of the land to be
approximately $31,800 and the building to be $124,700. Real estate taxes for the second half of
2009 were delinquent in the amount of $1,657.76. Code Enforcement estimates the cost to repair
the building to be approximately $40,000 to $50,000. The cost for demolition was esrimated to be
approximately $11,000 to $12,000. There had also been two suumiary abatements issued to this
property since 2008, four of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse and debris, cut ta11
grass and weeds, and remove snow and ice. Code Enforcement recommends the building be
repaired or removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that there wasn't an original
building permit; however, Ramsey County lists the property as being built in 1950. The property
had not been surveyed and the building did not have any potential as a historic resource to the
neighbarhood. Although the block face itself was contiguous and intact, she did not believe
demolition would have an adverse effect on the neighborhood.
Ms. Moermond noted from the photos that it appeazed there had been a fire at the property and
inquired about the fire. Mr. Magner responded that according to the fire incident report, the fire
occurred on November 21, 2008 in an upstairs bedroom which was contained to that bedroom. The
estimated damage to the property was approximately $60,000.
Ms. Elias stated that her client wished to rehabilitate the property and were willing to obtain a code
compliance inspection and post the performance bond. Ms. Moermond asked whether they had
applied for the code compliance yet. Mr. Elias responded that she had inquired about applying for
the code compliance from her client the previous day and did not lmow why they had not yet done
so. Ms. Moermond asked whether they had hired a contractor to go through the building yet to
determine the extent of the repairs. Ms. Elias responded that they had not.
Ms. Moermond stated that it did not appear the bank was serious in their intention to rehab the
property since it had been vacant for almost one year and no effort had been made to shorten the

— redemntion period on the foreclosure. She said that the fellowing must be ea�pleted in-ordes �oa--
vacant building form must be submitted; 2) the $5,000 performance deposit must be posted; 3) the
delinquent real estate taYes must be paid; 4) apply for a code compliance inspection; 5) a work plan
must be done by a contractor which will need to be revised upon receipt of the code compliance
inspection report; 6) provide a letter or affidavit from bank committing $50,000 towazds the rehab
project for this property; 7) must obtain clear title to the property; and 8) the properiy must be
maintained.
