omission therein and to make the same
Resolved, that such being necessary to correct an inadvertent error or
omission therein and to make the same conform to the true intent and purpose of this
Council, the resolution of this Council in the nature of a Final Order, Council
File 190477.9 approved January 6, 1959, hereby is amended to read as follows:
In the matter of opening and extending Wheeler Street to a width of 66 ft. from
Thomas Avenue to the southwesterly line of Lot "El".1 Dickermants Rearrangement, by
taking and condemning that part of Dickerman Park and that part of Dickermants Re-
arrangement from Thomas Avenue to the southwesterly line of Lot "EE', Dickermants
Rearrangement lying between the following described lines: The west line being the
west line of Wheeler Street as platted in Dickermants Rearrangement produced north-
erly to the southeast corner of Lot 30, Block 2, Dickerman Park, thence on a line
to the northeast corner of Lot 1, Block 2, Dickerman Park; The east line being the
east line of Wheeler Street as platted in Dickermants Rearrangement produced north-
erly to the southwest corner of Lot 16, Block 1, Dickerman Park, thence on a line
to the northwest corner of Lot 15, Block 1, Dickerman Park under Preliminary Order
186182, approved March 11, 1958, - Intermediary Order 189890, approved November 12,
1958.
A public hearing having been had upon the above improvement upon due notice,
and the Council having heard all persons, objections and recommendations relative
thereto, and having fully considered the same; therefore, be it
Resolved, By the Council of the City of St. Paul that the precise nature,
extent and kind of improvement to be made by the said City is to open and extend
Wheeler Street to a width of 66 ft. from `Thom -as Avenue to the- southwesterly line of
Lot "E ", Dickermants Rearrangement by taking and condemning that part of Dickerman
Park and that part of Dickermants Rearrangement from Thomas Avenue to the southwest-
erly line of Lot IIE ", Dickermants Rearrangement lying- be -tween the following described
lines: The west line being the west line of Wheeler'Street-as platted in Dickermants
Rearrangement produced northerly to the southeast corner of Lot 30, Block 2, Dicker -
man Park, thence on a line to the northeast corner of Lot-17- Block 2, Dickerman
Park; The east line being the east line of Wheeler Street as platted in Dickermants
Rearrangement produced northerly to the southwest corner of Lot 16,;31ock 1, Dicker -
man Park, thence on a line to the northwest corner of_Lot 15, Block 1,`"Dickerman
Park,,said opening and extension of Wheeler Street to be subject to a reservation
in favor of the owners and users of the existing railroad spur tracks located on

the land to be taken for street purposes, permitting said owners and users to main-
tain, reconstruct, and use said spur tracks on the present grades and alignments
thereof, or on such modified grades and alignments as may be required by the future
improvement of the portion of Wheeler Street being opened and extended, and the
Council hereby orders said improvements to be made.
Resolved Further, That the following land, lands or easements therein be and
the same are hereby ordered to be taken, appropriated and condemned for the purpose
of making said improvements, viz:
That part of Dickerman Park and that part of Dickermants Rearrangement from
Thomas Avenue to the southwesterly line of Lot "E", Dickermants Rearrangement lying
between the following described lines: The west line being the west line of Wheeler
Street as platted in Dickermants Rearrangement produced northerly to the southeast
corner of Lot 30, Block 2, Dickerman Park, thence on a line to the northeast corner
of Lot 1, Block 2, Dickerman Park; The east line being the east line of Wheeler
Street as platted in Dickermants Rearrangement produced northerly to the southwest
corner of Lot 16, Block 1, Dickerman Park, thence on a line to the northwest corner
of Lot 15, Block 1, Dickerman Park, the taking, appropriation and condemnation of
said lands to be subject to a reservation in favor of the owners and users of the
existing railroad spur tracks located on the land to be taken for street purposes,
permitting said owners and users to maintain, reconstruct, and use said spur tracks
on the present grades and alignments thereof, or on such modified grades and align-
ments as may be required by the future improvement of the portion of Wheeler Street
being opened and extended.
Resolved Further, That the Commissioner of Public Works be and is hereby in-
structed and directed to prepare plans and specifications for said improvement, and
the proper city officials are hereby authorized and directed to proceed with the
making of said improvement in accordance therewith.
