Whereas, The City of Saint Paul is
acquiring necessary additional ease-
ments in properties in Anoka County
for the improvement and extension of
the Waterworks System for the supply
of water serving the City of Saint Paul;
wHER kS, The City of Saint Paul is acquiring necessary additional easements in
properties in Anoka County for the improvement and extension of the Waterworks
System for the supply of Water serving the City of Saint Paul; and
wHmmS', An independent appraiser has been appointed by the Board of Water
Commissioners of the City of Saint Paul, with the approval of the City Council;
and
WHEREAS, Said appraiser has negotiated with the fee owner or owners thereof for
the purchase of 'an easement for waterworks purposes in two certain tracts of
land designated as Tracts 3D and 3F which are located in the southeast quarter of
the southwest quarter (SE� of the SW-41) of Section 1 in Tlmwhip 3) North of Range
24 West, at a maw price of approximately $625.00; and
WHEREAS, The Board of water Commissioners at its meeting held 27 May 1959 approved
said purchase as being practical and 6xpedient. and approved the acquisition of
said easements in said property for the benefit and use of the Water Department
of the City of Saint Paul and for the consideration above set forth, NOW, THEREFORE,
BE IT
RESCLVED, That the Co ipcil of the City of Saint Paul does hereby approve and
ratify said action of said Board of Water Commissioners, said consideration to
be paid out of Water Fund. 23-B.

W1;ZW 39 This Board heretofore has approved that certain extension of its waterworks system
called MISSISSIPPI RIM CONDUIT A0. 2 and the condemnation and taking of those certain lands
located in Anak i County which are not now possessed by the Board but which are to be occupied
by or affected by flowage or drainage or otherwise by reaaon of the extension of the water -
works system aforesaid; and
SAS.. Upon negotiations had therein with the approval of the Board, the oxner or owners
of Tracts 3D and 37 of said lands is willing to convey an easement in said Tracts to the
Board for the sun of $625.00, and this Board deems it advantageous to acquire said easement
in said Tracts for the am or consideration aforesaid, HAW, TBRRVC83, BE IT
BESOL9iD, That the Board of Water Co®isei.oners hereby approves and authorizes the palnuent
of $625.00 consideration to the owner or owners of said lands upon their delivering to the
Board a good and sufficient Deed conveying to the Board of Water Cowisaimers of the City
of Saint Paul a perpetual and par no unt easement for public waterworks purposes and the
extension of the Public Waterworks System of the City of saint Paul, including but not
jisdted to the construction, 3nstallation,*n intenancd and operation of public water wins,
water supply conduits and other water supply inatruaentalities as extensions and integral
parts of said Public Waterworks System in, under, across and through those certain lands in
Atoka Comby which are designated as said Tracts 3D and 3g, the same being more particularly
described as follwa, to wits
3D) All that certain tract of land comprising that certain portion of the southerly
100 feet of the southeast quarter of the southwest quarter (SFJ of the SR}) of Section 1
In Township 30 Borth of Range 24 West, County of Anoka, Minnesota, which is embraced
and included between the east and west lines of Lot 10 of Auditor's Subdivision No. 1
or said lines extended,
*=opting therefrom and exclusive of all of any portion thereof which is comprised by
those certain lands awe particularly bounded and described as follows, to wits
All that certain portion of above described said certain tract of land which is
eonprised by the public higher embracing the southerly 33 feet of the southeast

That portion of sand tract which lies north of, adjacent to and abutting on the northerly
side of that certain sixty -foct strip or parcel of land described in the above, oontains
924 square feet or 2AOO acres of land, more or less; and
3F) All that certain tract of land comprising that certain portion of the southeast
quarter of the southwest quarter (SF} of the S1f4) of Section 1 in Township 30 North of
Range 24 Vest, County of Anoka, which is more particularly bounded and described as
follows, to wits
Beginning at the south quarter (S4) corner of said Section 1, thence in nortberly
direction along the north -south quarter section line 104.7 feet more or less to
an intersection with the extended southerly line of Lot 12 of Auditor's Subdivision
No. 124; thence westerly along the southerly line of said Lot 12 or said souther].,y
line extended., 315.35 feet more or less to the westerly line of said Lot 12; thence,
in southerly direction along the westerly line of said Lot 12 or said westerly line
extanided, 497 feet sore or less to a point lying 100 feet at right angles northerly

SR4) of said Section 1; thence, westerly along a line Lying 100 feet at right angles

soethwnst quarter of Section 1, Township 30 North, Range 24 presto which lies
izoediately north of the 66 -foot public highway and wherein a perpetual saseaent
was condemned and taken by said Board pursuant to proceedings in condennati,on the
records whereof are filed in Docket 8475 in the office of the Clark of Court, at
Anoka, Minnesota,
cartaining about 5,236 square feet or 12/100 acres of land, sore or less, of which about
585 square feet or 1/100 acres of lend, more or less, lie in the easterly 50 feet thereof
and subject to the public right in said Central Avenue.
The intent herein is, that said Auditors Subdivision No. 124 shall be interpreted
according to the plat of sage on file and of record in the office of the Register of
Deeds in and for said County of Anoka.
BE IT Ftiili'i RESOLVED, That the honorable City Council be requested to approve and confirm
this action of the Board of Water Cc®issioners and to authorize and direct payment of ;62540
to the owner or owners thereof upon their delivering to the Board the deed of eassment afore-
said with respect to said Tracts 3D and 3F, said sum to be paid out of the Water Fund 23B.
