WHEREAS, a resolution pursuant to Council File No. 09-656, adopted by the City Council on June
17, 2009, ordered the repair or removal of 1016 Bush Avenue within fifteen days of the adoption of the
resolution; and
WHEREAS, Stephen J. Keane, a co-owner of the property, filed a petition for a writ of certiorari to
the Minnesota Court of Appeals, which issued said writ; and
WHEREAS, the Council stayed the enforcement of the repair or remove resolution pending the
outcome of the appeal, under Council File No. Q9-lOQ2; and
WHEREAS, the appeal has now been dismissed by the Relator, and the Court of Appeals has
issued an Order discharging the Writ and dismissing the appeal; now, therefore, be it
RESOLVED, that the stay of enforcement of Council File No. 09-656, set forth in Council File
No. 09-1002, is hereby revoked.
