The legal description iss except part taken for Prosperity Avenue, Lots 21, 22; that part of Lot_23 lying north of Prosperity Avenue; also that part of vacated Prosperity Avenue adjoining said lots, and all :of Lot 20, Block 3; Kieffer Park. The zoning is Heavy Industrial and has been since the adoption of the Ordinance in 192: The existing station was erected in'1932, and in 1952 an application was made to remodel the station. At that time, field investigation discloses that part of the filling station operation was being conducted within the street right -of -way of Prosperity Avenue, The Board recommended approval subject to the development of the station within the applicant's property lines, and in accordance with filling station standards. The applicant withdrew his request before'Council action was taken. , On December 15, 1956, the City Council vacated a portion of Prosperity Avenue lying easterly of the existing filling station and acquired an equal portion of land'to the east of the original right -of -way thus changing the original alignment of Prosperity Avenue. The present application now includes the part of Prosperity Avenue which was vacated and a plan for the remodeling which complies with the filling station standards. The tract under consideration is irregularly shaped with a front- age of approximately 67 feet on Jessamine Avenue and 147 feet on Prosperity Avenue. The average depth from Jessamine Avenue is 121 feet resulting in an area of approximately 132129'square feet. The adjacent land uses are; north and adjoining is vacant land; mast and adjoining is a single - family residence which fronts on Jessamine Avenue; south across Jessamine Avenue is Johnson Parkway; east across Prosperity Avenue is the future site of the Phalen Shopping Center which is now under development. The Traffic Engineer has approved the plans which meet the standards for this type of facility. Field investigation discloses no basic objection from the standpoint of adjacent land uses as this will be a definite improvement over the existing station. The driveway openings from Jessamine and Prosperity Avenues will be installed at such time as Prosperity Avenue is constructed along the new alignment. In consideration of the above factors, the Board of Zoning recommends the granting of this permit to remodel an existing filling station on the above described property in accordance with plans approved June 4, 1959, Sincerely, H 1 :m Q 1 Herbert C.
