This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64 inclusive of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, a$ amended, be and the same is hereby further amended so as to rezone the following described property from "Bl" Residence District to "C" Residence District, to -wit: Section 2. This ordinance is hereby declared to be an emergency ordinance.rendered necessary for the preservation of the public peace, health and safety. Section 3. Harned to rezone from U Bn to .tC" Residence the rear portion of certain lots located on the east side of Lexington Parkway between Rondo and Carroll Avenues. The legal descrip- tion is fully described in the attached petition. The present zoning of the part of the property under consideration is "Bit Residence and has been since the adoption of the ordinance in 1922. On May 12, 1959s the Commissioner of Finance reported the petition sufficient with the owners.of six of the nine tracts (67 %) of land within the prescribed 100 feet having signed the petition. The applicant is the owner of property part of which is zoned "CR Residence and -the rear portion of which is zoned "Bit Residence. He proposes to develop the entire site with a 21 unit apart- ment building with off - street parking accessory thereto. However, in order to do so, it is necessary for him to have the entire property in a "C" Resi- dential classification. The entire site is "Lit shaped having 81.93.feet of frontage along North Lexington Parkway and a depth of 175.31 -feet; it also has a frontage of 61.64 feet along Rondo Avenue with a depth of 192.33 feet resulting in an area of approximately 21,113 square feet. 83.1% of the area is presently zoned "C" Residential. The part of the area under consideration for rezoning is rectangular in shape with an area of 3,570 square feet. (See attached map of the area). The adjacent land uses of the entire area area north and adjoining are two three -story brick faced apartment buildings which front on North Lexington Parkway; south and adjoining are two single - family residences also fronting on Lexington Parkway., also the Oxford City playground which fronts on Carroll Avenue; west across Lexington Parkway is Central High School; east and adjoining is the Oxford City playground. Field investigation discloses no basic objection to the rezoning of.this property to "C" Residence as it would be in character with the surrounding development and would not be detrimental to the adjoining property owners. This proposed 21 unit apartment building meets the recommended standards for density and,bnilding ground coverage. In consideration of the above factors, the Board of Zoning recommends the granting of this petition to rezone from "B" Residence to "C't Residence the property as described on the applicant's petition.
