That the Zoning Code, Chapters 60 to 64 inclusive of the Saint Paul Legislative Code, pertaining to Use Districts, HeightsDistricts and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "Blt Residence District to "C" Residence District: Lots 3, 4 and 24, Block 3, Drake's 2nd Addition, according to the plat thereof on file and of record in the office of, the Register of Deeds in and for Ramsey County, Minnesota, located on the west side of Jackson Street between Sycamore and'Acker,Streets and on the north side of Acker Street between Jackson Street and Lightner Place, subject to the following express exceptions and conditions: 1. The legal description is: Lots 3, 4, 24, Block 3, Drake's 2nd Addition. The zoning is 1'3" Residence and has been since the adoption of the-Ordinance in 1922. Each of the petitions has been reported sufficient by the Commissioner of Finance. 'The two tracts under consideration actually adjoin each other and will be utilized for one development. The combined petitions indicate that 81.8 per cent or 18 of the 22 property owners within the prescribed 100 feet of the two tracts under consideration have signed the petitions. The two lots on Jackson Street which are included in Mr. Whalen's petition are now developed with a church building which was moved to this site for the purpose of converting it to a six -plex. The lot on Acker Street which is included in Mr. Blank's petition is presently undeveloped, but is used as a means of access to a garage on the property which lies directly to the north of this lot. This lot will be developed for off- street parking in conjunction with the proposed six -plex on Jackson Street. The combined tracts have a frontage of 72 feet on Jackson Street with a depth of 95 feet, and 40 feet on Acker Street with a depth of 108.48 feet, resulting in a combined area of approximately 11,179 square feet. The adjacent land uses are: north and adjoining is an apartment building which fronts on Jackson Street; east across Jackson Street is a mixture of residential uses and a tavern located on the northeast corner of Jackson and Acker streets; south and adjoining is a vacant lot and a single family residence adjoining it which fronts on Jackson Street; south across Acker Street is vacant land; west and adjoining are vacant lots. Field investigation discloses that a moving permit and a foundation permit were issued by the building department, and also a permit to convert this structure for use as a duplex only. Field investigation further discloses that the building is presently being converted into a six -plex. The recommended standards for density and building ground coverage will be met, and in the event that the property is re- classified, sufficient-off-street parking thereto will be provided. There is no basic objection to this rezoning as it would be in accordance with the preliminary land use guide plan. It would be consistent with the existing uses in this area and would not be detrimental to the adjoining property. In consideration of the above factors, the Board of Zoning recommends the granting of this petition to rezone from "B" to "C" Reside ce, the above described property. Sincerely, C.
