An ordinance granting permission to Board of
Christian Service, owner of Bethesda Lutheran Hospital at
559 Capitol Boulevard, Saint Paul, Minnesota, in connection
with construction of proposed addition to said Bethesda
Lutheran Hospital Building, to temporarily block off and exclude
from public traff icocertain portions of Capitol Boulevard
between Charles and Como Avenues, and several other sections of
public street upon which said Hospital premises abut. This is
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES C3 DA IN:
Section 1. That permission hereby is granted to Board of
Christian Service as owner of Bethesda Lutheran Hospital and its
premises,'for the purpose of accommodating the construction of the
proposed addition to said Bethesda Lutheran Hospital Building,
to block off and exclude from public traffic, temporarily, certain
areas of Charles Avenue, Capitol Boulevard, and Como Avenue, in
the City of Saint Paul, and the Commissioner of Public Works hereby
is authorized to issue h1permit therefor to said Board of Christian
Service, subject to the following provisions, terms and conditions;
1. Said permittee, at its own cost and expense,
for said purposes, under the supervision and subject to.the direction
of the Commissioners of Public Works and Public Safety, and that of
the Traffic Engineer, for the use of said Capitol Boulevard between
said Charles and Qmo Avenues and that part of said Charles Avenue
hereinafter mentioned, during the construction period shall :
a. Provide and maintain approved temporary
barricades and controlled access of Capitol Boulevard
at the intersection of Charles Avenue, to insure free
use of Capitol Boulevard, at said location, as a temporary
construction area for the passage of contractors' trucks
hauling materials necessary for construction operations,
storage of construction materials and access for public
fire, police and other vehicles.
b. Provide and maintain approved temporary
barricades and controlled access of Charles Avenue
and Como Avenue upon which said-Hospital premises abut,
permitting free access for the passage of contractors'
trucks hauling materials necessary for construction
operations, storage of construction materials and access
for public fire, police and otter vehicles.
c. Restore all sidewalks, i0onformity with the.
City's standard plans for monolithic oncrete sidewalks,in
all sidewalk's areas affected by the exercise of said permit
in respect of breakage or removal, and restore all street
surfaces and P remises otherwise thereby affected, to then
original condition.

d. Said permittee shall exercise any and all
privileges hereby provided to be granted only to the
extent necessary, from time to time, to reasonably
accommodate the requirements of the construction of said
addition to said Hospital Building by said permittee, and
at all times subject to the supervision, order and
direction of said Commissioners and said Traffic Engineer
and not otherwise.
e. Said permittee shall fully indemnify and save
harmless said City, its officers, employees of and from all
lbbility of every kind and nature for injury to person or
property which,shall arise therefrom or be incurred in
connection with any of said permittee's operations hereunder.
f. Said permittee shall furnish a bond in the
amount of $10,000 to the City of Saint Paul, conditioned
to comply with all the terms of this ordinance, and to
indemnify and save the City harmless from any and all loss,
liability, judgments, suits, costs, charges, damages or
expense that may accrue to person or property occasioned
by the operations of the permittee hereunder.
g. Said permittee and its successors and assigns
shall furnish and maintain and pay all premiums and other
expense for, casualty insurancea)verage by a my licensed
casualty insurance company in thefsmount of $00,000.00

any single accident, and in the amount of $25,000.00 against
liability for injury to property in any single accident.

days next after the effective date of this ordinance, file
