PRESENTED BY ORDINANCE NCL 19,mw Z ,21.:r19Jls gtti2rtF+� SS[ 2T9f1h� T . *.•/,r' rr" r�,xml An ordinance authorizing the issuance of a permit to Whirlpool Corporation, to construct, maintain and operate a reinforced concrete foot bridge seven feet nine inches in width, extending from permittee's building on Lot 6, Auditor's Subdivision No. 57, Ramsey Canty, Minnesota, to the Forest Street Bridge, on direct line opposite Pier No. 4 of said Forest Street Bridge shown on the Official Drawings of said Bridge on file in Bureau of Bridges, Department of Public Works, dated May 16, 1941, at elevation approximating that of sidewalk of said Forest Street Bridge. This is an emer- gency ordinance rendered necessary for the preservation of the public peace, health and safety. THE -COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Commissioner of Public Works hereby is authorized to issue a permit to Whirlpool' Corporation to construct, maintain and operate a reinforced concrete foot bridge seven feet nine inches in width, extending from permittee's building on Lot 6, Auditor *s Subdivision No. 57, Ramsey County, Minnesota, to the Forest Street Bridge on direct line opposite Pier No. 4 of Forest Street Bridge shown on the Official Drawings of said Bridge on file in_ Bureau of Bridges, Department of Public Works, dated May 16, 1941, at elevation approximating that of sidewalk of said Forest Street Bridge, within the corporate limits of the City of Saint Paul, Ramsey County, Minnesota, subject to the following condition-s: t. That said permittee, prior to the commencement of the construction and erection of said reinforced concrete foot bridge, hereunder, at said permittee's own cost and expense, and by a competent Registered Architect or Engineer, shall cause to be prepared and submitted to the Chief Engineer and the City Architect of the City of Saint Paul, two complete sets of proper detailed plans and specifications for said structure, which shall be subject to the approval of said Chief_ Engineer and said City Architect. 4. Said permittee shall, at its own cost and expense, as aforesaid, construct and erect said reinforced concrete foot bridge in strict accordance with said plans and specifications therefor, as approved by the Chief Engineer and the City Architect, of the City of Saint Paul, and subject-to the inspection, supervision and approval of said Chief Engineer and said City Architect, and shall fully reimburse said City, upon receipt of proper invoices therefor, on account of all costs and expenses necessarily incurred for inspection and engi- neering services, by said City, in the premises. .5-., -That said permittee, and its successors and assigns, shall fully indemnify the City of Saint Paul against all liability on account of all claims, causes of action, suits and judgments on account of injury to person and/or property arising from or connected with the construction, maintenance, operation and/or removal of said reinforced concrete foot bridge, hereunder; and that supplemental to all other obligations on their part, jointly or severally, hereunder, said permit tee and its successors and assigns shall furnish and maintain, and pay all premiums and other expenses for, casualty insur- ance coverage by aaduly licensed casualty insurance company, in the amount of $300,000.00 against liability for injury to any person and/or persons in any single accident, and in the amount of $25,000.00 against liability for injury to. property in any single accident, indem- nifying said permittee, its successors and assigns and the City of Saint Paul, jointly and severally, against liability _ on account of all claims of third persons on account of injury to person and/or property arising from or connected with the construction, - maintenance, operation and/or removal ; of said reinforced concrete foot bridge, hereunder, and shall furnish -competent evidence of said coverage, from time to -- time, to the Comptroller, of the City of Saint Paul. That said reinforced concrete foot bridge shall be discontinued and removed by and at the expense of said permittee and/or its successors in interest whenever the Council of the City of Saint Paul shall by resolution determine such discontinuance and removal are necessary in the public interest and order the discontinuance and removal of the -same. 8. That said permittee shall, within the period of ten days next after the effective date of this ordinance, file with the City Clerk, its written acceptance of this ordinance, among other things, con- taining its covenant binding said permittee and its successors and assigns under said City, according to the provisions, terms and conditions of this ordinance, which written acceptance and covenant shall be approved by the Corporation Counsel. Section 2. This ordinance is hereby declared to be an emergency ordinance'J- rendered necessary for the preservation of the public peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, approval and publication.
