emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclusive
of the Saint Paul Legislative Code, pertaining to Use Districts,
Height Districts and Rezoning of certain properties in the City
of Saint Paul, as amended, be and the same is hereby further
amended so as to rezone the following described propwty from
"C" Residence District to Commercial District:
The westerly 50 feet of Lots 17 and 18,
Block 29, Rice and Irvine's Addition,
according to the plat thereof on file
and of record in the office of the
Register of Deeds in and for Ramsey
County, Minnesota, located on the south-
westerly side of Sherman Street between
'Exchange and Ramsey Streets.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be in force
upon its passage, approval and publication.

This is in the matter of the petition of Nellie E. Nesland to rezone certain
property located on the southwesterly side of Sherman Street between Exchange and
Ramsey Streets. The legal description is: westerly 50 feet of Lots 17 and 18,
Block 29, Rice & Irvine's addition. The zoning is "C't Residence and has been
since the adoption of the Zoning Ordinance in 1922.
On May 14, 1959,, the Commissioner of Finance reported this petition sufficient
with 75% or six of the eight owners of property within the prescribed 100 foot
radius of the property under consideration having signed the petition. The
property has a frontage of 50 feet along Sherman Street, and a depth of 120 feet,
resulting in an area of 6,000 square feet.
The site is presently occupied by a single - family residence with rooms available
for rent. The residence was built in 1862 according to the records in the County
Assessor's office. The applicant proposes to continue the present use, and to
convert one room of this residence into a beauty parlor to be operated by the
petitioner.
The adjacent land uses are: east and adjoining are the Montana apartments, a
three -story brick building which fronts on Exchange Street; west and adjoining is
a large multi - family residence fronting on Sherman Street; north across Sherman
is a vacant lot and a mixture of multi- and two - family residences; south and
adjoining is the yard of a residence which fronts on Exchange Street.
Field investigation discloses that the area is old and has a mixture of all types
of residential uses. The neighborhood is deteriorating and will require sub-
stantial rehabilitation and possibly redevelopment. The preliminary land use
guide plan indicates that this area would be best suited for light industrial
development, as a substantial portion of the area, particularly toward the loop
and along West Seventh Street, is developed that way. To rezone this site to
"commercial", for the purpose of establishing a beauty parlor, would constitute
"spot zoning".
The Board of Zoning considered this petition at their meeting on June 4, 1959
and recommend the granting of this petition to rezone the above described
property for the purpose of establishing a beauty parlor in the home.
