WHEREAS, the Contract for the construction of the BATTLE
CREEK SEWER TRUNK AND BRANCHES, comptrollerts contract
L-5957P L and L Joint Venture, Contractor, has been prac-
tically completed, and
WHEREAS, said Contractor requests that a portion of the
15% retained under the contract from estimates of work
done, be-paid in. advance of the final payment of the final
estimate, and
WHEREAS, the Commissioner and Chief Engineer of the Depart-
ment• of Public Works approve the payment at this time of
$140000-00 of the $148.,500.00 retained, therefore be it
RESOLVED, that the proper City Officials be and they are
hereby authorized to pay an estimate in the amount of
8140;000.00'from the retained percentage amounting to
148, 500.00, to said Contractor, and be it
FURTHER RESOLVED, that this Resolution shall no force or
effect, unless the Sureties on the Contractor's Bond
consent thereto in writing and file such consent with the
City Comptroller,
