The rehabilitation or demolition of the structure to be completed within �fteen (15) days after the date of the Council Hearittg; and WHEREAS, a hearing was held befare the Saint Paul City Council on Wednesday, November 4, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 532 SHERBURNE AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of tUis building(s) is estimated to exceed five ffiousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Properiy. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. a �� That the deficiencies causing this nuisance condirion haue not been conected. That Department of Safety and Inspecrions has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. The rehabilitation or demolition and removal of the structure must be completed within fifteen (15) days after the date of the Council Hearing. If the above corrective acfion is not completed witrun trus period of time Deparhnent of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subj ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal sha11 be removed from the property by the responsible parties by the end of this time period. If a11 personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. This property was inspected as a duplex. 09-1247 As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by July 29, 2004 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove Yhe building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance withlaw. As an �wner or responsibie party, you are required by law to provide full and complete disclosure of this "Order to Abate" to a11 interested parties, all present or subsequent renters and any subsequent owners. The property shall tlot be sold, transferred or conveyed in any manner until the Nuisance Conditions have been abated and the Certificate of Code C�mpliance or Certificate of Occupancy has been issued. The Enforcement Officer is required by law to post a placaxd on this property which declares it to be a"nuisance condirion", subjecY to demolition and removal by the City. This placard shali not be reinoved without the written authority of the Department of Safety and Inspections, Division of Code Enforcernent. If carrective action is not taken within the time specified in this order, the Enforcement Offieer will notify Che City Council that abatement acrion is necessary. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolurion calls for abatement action the Council may either order the City to take the abatement action or fix a time within whlch this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City sha11 abate this nuisance. Brad Ballard, K-3 Investments, LLC, appeared and stated that he was the property owner. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one and one-half story, wood frame, on a lot of 4,792 square feet and had been vacant since March 7, 2006. A code compliance inspection had been done on October 22, 2007 which had since expired, the vacant building registration fees in the amount of $1,000 went to assessment on March 27, 2009, and the $5,000 performance bond had not been posted. On June 3, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 29, 2009 with a compiiance date of July 29, 2009. To date, the property remained in a condirion which comprised a nuisance as defined by the Le�slative Code. Ramsey County Tasatioii estimated the market value of the land to be appmximately $20,400 and the building to be $8Q,500. Real estate taxes for the first half af 2009 were delinquent in the amount of $1,262.24, Code Enforcement estimates the cost to repair the building to be appzoximately $75,000 to $85,000. The cost for demolition was estimated to be approximately $10,000 to $12,000. There had also been 21 sinnmary abatements issued to this property since 2006, 24 of which went to work order: remove improperly stored refuse and debris, boarding/securing, cut tall grass and weeds, and remove snow and ice. Code Enfarcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked about Yhe history of the summary abatement orders which resulted in wark orders at the property. Mr. Magner responded that the orders were consistent since 2006 whett the building became vacant. The last summary abatement order was in July 2009. Mr. Ballard stated that ha had purchased the property at a foreclosure sale but did not remember when he had closed on the property. He said he had the financing available to do the rehab of tlus project and had completed the rehabilitation of several other properties in St. Paul as well. He said he had logistical problems completing the rehab of another property at 422 Charles Avenue but the repairs were at least 60 percent completed and requested additional time to complete the rehab. Ms. Moermond responded that fhe deadline to complete the repairs had since e;tpired and she did not have the authority to make any recommendataon on granting any additional time. Ms. Moermond stated that it appeared he was not maintaining the property given the number of summary abatement orders which resulted in work orders. Mr. Ballard acknowledged that he had not always kept up with mowing the lawn; however, peopie also were dumping on the property since it was a vacant building. Ms. Moermond stated that it appeared the building was a legal, non-conforming duplex. Mr. Ballard responded that he believed the second unit was a mother-in-law apariment. Ms. Moermond stated that the following conditions must be met by the close of business on Monday, October 26 in order to receive a grant of time to complete the rehabilitation of the property: 1) provide closing documents indicating the date the property was purchased; 2) pay the outstanding real estate taaces; 3) post the $S,OOO.QO performance bond; 4) the property must be de- converted from a duplex to a single-family dwelling; 5) a Code Compliance Inspection must be 09-1247 __.____ _..
