1 WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair ar wrecking
3 and removal of a one and one half story, wood frame duplex and its wood accessory shed in
4 backyard located on property hereinafter refened to as the °Subject Property" and commonly

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before March 22, 2009, the
following are the now known interested or responsible parties for the Subject Property: Justin
Hatcher, 20 2 Street 1VE, #1007, Minneapolis, MN 55413; Justin Hatcher, 2230 W County
Road C, Roseville, MN 55113-2504; Wilford & Geske, PA, 8425 Seasons Parkway, Woodbury,
MN 55125-4392; Thomas-Dale District 7 Planning Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance witk the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated June 29, 20�9; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Pxoperty is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the 5ubject Property by July 29, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building{s) to constitute a nuisance condirion; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul L,egislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held befare the Legislative Hearing Officer of the Saint Paul
City Council on Thursday, October 15, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to arder the

interested ar responsibie parties to make the Subject Property safe and not detrimental to the
pubiic peace, heakh, safety and welfare and remove its blighting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within �fteen
(15) days after the date of the Council Hearittg; and
WHEREAS, a hearing was held befare the Saint Paul City Council on Wednesday,
November 4, 2009 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 532 SHERBURNE AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of tUis building(s) is estimated to exceed
five ffiousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Properiy.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condirion haue not been conected.
That Department of Safety and Inspecrions has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitared by Deparhnent of Safety and
Inspections, VacantlNuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

biighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the shucture in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
If the above corrective acfion is not completed witrun trus period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subj ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
sha11 be removed from the property by the responsible parties by the end of this time
period. If a11 personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accardance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, duplex on a lot of 4,742 square feet.
According to our files, it has been a vacant building since Mazch 7, 2006.
The current property owner is K3 Investments, LLC, per Nancy with Mortgage Elect Systems.
There have been twenty-one (21) SUMMARY ABATEMENT I�TOTICES since 2006.
There have been twenty-four (24) WORK ORDER(S) issued for:
- Improperly stored refuse, garbage and misc debris
- Boarding/securing
- Removal of tall grass and weeds
- Removal of snow and ice
On 7une 3, 2009, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on 3une 29, 2009 with a compliance date of
July 29, 2009. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid. (20D9-2010 was assessed on 3/27I09)

The VacanUNuisance Buildings Unit, Department of the Department of Safety and
Inspectians, Division of Code Enforcement, hereby declares the premises located at:

On June 03, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As �irst
remedial action, a Code Compliance Inspection must be obtained from the Department of
Safety and Inspections, 375 Jackson St., Suite 220. That inspection will identify specific
defects, ttecessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance bond with the
DeparCment of Safety and Inspections before any permits are issued, except for a

This building(s) is subject to the restrictions of Saint Paul Ordanance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance ar a Certificate
of Occupancy has been issued.
This is a one and one half story, wood frame duplex ard its wood accessory shed in backyard.
A code compliance report was done on October 22, 2007 by Jim Seeger. Details of the report
are as fallows:
SUILDING
l. Keplace steps at street.
2. Replace steps at front door and install a landing to code.
3. Install cover on rear basement access to meet code.
4. Repair sidewalks to keep water and rodents out.
5. Install retuins on all handrails.
6. Install flashitig on chimney to cade and repair brickwork.
�. Install hand surface to code for basement floor.
8. Insure I- hour fire rated separation between units.
9. Insure basement cellar floor is level, is cleanable, and a71 holes are filled.
10. Install hand and guardrai]s on all stairways and steps as per attachment.
1 I. Install plinth blocks under posts in basement.

13. Install twenry minute fire-rated doors, with a self-closing device, between common areas
and individual units,
14. Provide tl�umb type dead bolts for all enh doars. Remove any surface bolts.
I 5. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessary.
16. Provide compiete stonns and screens, and repair all door and window openings.
17. Repair walis and ceilings throughout, as neeessary.
18. Prepare and paint interior and exteiior as necessary (take the necessary precautions if lead
base paint is present).
19. Any framing members that do not meet code (where wall and ceiling covering is removed,
members that are over-spanned, over-spaced, not being carried properly, door and window
openings tha2 are not headered, etc.) are to be recanstructed as pea eode.
20. Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom
windows sha11 meet emergency egress requirements (20" wide minimum, 24" high
minimum but not less than 5.7 sq. ft. overall).
21. Provide general clean-up of premise.
22. Provide sinoke detectors as per the Minnesota State Building Code.
23. Repair soffit, fascia triin, siding, door trim and window trim, to code.
24. Provide proper drainage around house to direct water away from foundation.

1. Verifylinstall a separate 20 ampere laundry circuit & a separate 20 ampere kitchen appliance circuit.
2. Install or replace GPCI receptacle in basementJfirst bathroom/second bathroom adjacent to the sink.
3. Ground bathroom light in basement/first(second/ bathroom and disconnect receptacle on fixture.
4. Repair or replace atl broken, missing or ]oose light fixtures, switches & outiets, covers and plates.
5. Check all 3-wire outlets far proper polarity and verify ground.
6. Remove any 3-wire ungrounded outlets, a�id replace with 2wire, or g 3-wire to code.
7. Thxough-out building, instalt outlets and light fixtures, as specified in Bulletin 80-i .
8. Install exterior lights at frontlszdelback entry doors.
9. Remove andlor re�vire all illegal, improper or hazardous wiring in basement(garage.
10. All elecCrical work must be done by a licensed electrical contractor under an electrical pennit.
11. Any open walls, or walls that are opened as part of this project, must be wired to the standards of the
2005 NEC.
12. Add receptacle in second floor bedroom.
PLLTMBING
Ail plumbing work requires permit(s) and must be done by a plumbing conh•actor licensed in
Saint Paul.
Baseinent:
1. Water heater is not fired or in service.
2. Water piping is inconect.
3. Show that water heater vent goes into a lined chimney.
4. Water meter is removed and not in service.
5. Water pipe sizing is incorrect.
6. Replace corroded gas piping.
7_ Dryer gas shut-o£� connector or gas piping is incorrect.
HEATING
I. Repair duct work at furnace in baseinent.
2. lnstall approved gas valve on first level furnace_
3. Recommend installing approved lever handle manual gas shutoff valve on gas appliances.
4. Recommend installing approved automatic gas valve for furnace.
5. Ciean and Orsat furnace. Gheck a11 cantrols for proper operarion. Submit repart from
licensed contractor.
6. Check furnace heat exchanger for leaks and provide documentation.
7. Tie furnace and �vater heater venting into chimney liner.
8. Clean all supply and return ducts for warm air heating system.
9. Repair and or replace heating registzrs as necessary.
10. Appropriate mechanical permits are required for this work.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by July 29, 2004 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove Yhe building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance withlaw.
As first remedial actian, a Code Compliance Inspection Re�ort must he obtained from the
Building Inspecrion and Design Section, 375 7ackson Street, Suite 220, (651)266-8989. This
inspection will adentify specific defects, necessary repairs and legal requirements to correct this
nuisaiice condition.
If this building is located in a historic district or site (noted above, }ust below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your praposal for
the repairs required by this order and compliance with preservation a idelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staff No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 65]-266-9078.
As an �wner or responsibie party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to a11 interested parties, all present or subsequent renters and
any subsequent owners. The property shall tlot be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code C�mpliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placaxd on this property which declares it
to be a"nuisance condirion", subjecY to demolition and removal by the City. This placard shali

Brad Ballard, K-3 Investments, LLC, appeared and stated that he was the property owner.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one and
one-half story, wood frame, on a lot of 4,792 square feet and had been vacant since March 7, 2006.
A code compliance inspection had been done on October 22, 2007 which had since expired, the
vacant building registration fees in the amount of $1,000 went to assessment on March 27, 2009,
and the $5,000 performance bond had not been posted. On June 3, 2009, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on June 29, 2009 with a compiiance date of July
29, 2009. To date, the property remained in a condirion which comprised a nuisance as defined by
the Le�slative Code. Ramsey County Tasatioii estimated the market value of the land to be
appmximately $20,400 and the building to be $8Q,500. Real estate taxes for the first half af 2009
were delinquent in the amount of $1,262.24, Code Enforcement estimates the cost to repair the
building to be appzoximately $75,000 to $85,000. The cost for demolition was estimated to be
approximately $10,000 to $12,000. There had also been 21 sinnmary abatements issued to this
property since 2006, 24 of which went to work order: remove improperly stored refuse and debris,
boarding/securing, cut tall grass and weeds, and remove snow and ice. Code Enfarcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked about Yhe history of the summary abatement orders which resulted in wark
orders at the property. Mr. Magner responded that the orders were consistent since 2006 whett the
building became vacant. The last summary abatement order was in July 2009.
Mr. Ballard stated that ha had purchased the property at a foreclosure sale but did not remember
when he had closed on the property. He said he had the financing available to do the rehab of tlus
project and had completed the rehabilitation of several other properties in St. Paul as well. He said
he had logistical problems completing the rehab of another property at 422 Charles Avenue but the
repairs were at least 60 percent completed and requested additional time to complete the rehab. Ms.
Moermond responded that fhe deadline to complete the repairs had since e;tpired and she did not
have the authority to make any recommendataon on granting any additional time.
Ms. Moermond stated that it appeared he was not maintaining the property given the number of
summary abatement orders which resulted in work orders. Mr. Ballard acknowledged that he had
not always kept up with mowing the lawn; however, peopie also were dumping on the property
since it was a vacant building.
Ms. Moermond stated that it appeared the building was a legal, non-conforming duplex. Mr.
Ballard responded that he believed the second unit was a mother-in-law apariment.
Ms. Moermond stated that the following conditions must be met by the close of business on
Monday, October 26 in order to receive a grant of time to complete the rehabilitation of the
property: 1) provide closing documents indicating the date the property was purchased; 2) pay the
outstanding real estate taaces; 3) post the $S,OOO.QO performance bond; 4) the property must be de-
converted from a duplex to a single-family dwelling; 5) a Code Compliance Inspection must be

This is to confirm with you that at the Legislative Hearing on October ] 5, 2009, Marcia
Moermond, the Legislative Hearing Officer, stated that the following conditions must be met by
the close of business on Monday, October 26, 2009 if you intend to rehabilitate the building:

provide closing documents indicating the date the property was purchased;
outstanding real estate taxes must be paid with Ramsey County;
the $5,000.00 performance bond must be posted;
the property must be de-wnverted from a duplex to a single-family dwelling;
a Code Compliance Inspection must be completed;
a work plan needs to be done in accordance with the code compliance inspection report;
provide financial documentation indicating the ability to complete the repairs (the
estimated cost of the repairs is $75,000 to $85,000);
provide an affidavit dedicating the funds from an account for this project; and
the property must be maintained.
The City Council Public Hearing is scheduled for Wednesday, November 4, 2009, at 5:30 p.m. in
Room 300 Council Chambers.
