The property is describdd,as Lots 1 thru 15 inclu- sive, Block 1, Whitney's Rearrangement. The property has been zoned "A" Residence since the adoption of the Ordinance in 1922. On July 16, 1959, the Commissioner of Finance reported the petition sufficient with the owners of'66 2/3go (20 out of 30) tracts of land within the prescribed 100 foot radius having signed the petition. At the present time, Lots 1 thru 4 are developed with a single - family residence which was constructed in 1948, and Lots 5 thru 15 inclusive are vacant. The applicant proposes to develop the vacant lots with three 17 -unit apartment buildings, with off- street parking accessory thereto for 51 car spaces, leaving Lots 1 thru 4 for single-family use. The proposed development meets the recommended standards for density and building ground coverage. The property under consideration has a frontage of 600.4 feet along Norfolk Avenue and a frontage of 127 feet along both Wheeler and Davern Streets, resulting in a total area of 76,250.8 square feet, or 1.75 acres. The proposed apartment site will involve the westerly 440 feet of the Norfolk Avenue frontage, or an area of 55,880 square feet which is 1.28 acres. North across Norfolk Avenue are six single - family residences fronting along Norfolk Avenue; south across an unimproved alley is the Remington -Rand employee parking lot; east across Davern Street is vacant land which is zoned Light Industrial; west and across south Wheeler Street is a single - family residence fronting along Norfolk Avenue, diagonally across the intersection of Norfolk Avenue and Davern Street is unimproved land which is zoned commercial. Field investigation discloses that the reclassification of this property from "A" to "C" Residence would not be detrimental to the adjoining properties. The pro- posed apartment building would provide a transitional use between the existing single - family residences now fronting on Norfolk Avenue, and the Remington -Rand plant to the south. The triangular area which is directly to the north of the property under consideration and is bounded by West Seventh Street, Davern Street, and Norfolk Avenue, is presently developed with a mixture of uses. The West Seventh Street frontage is basically commercial, and the remainder of this tract is de- veloped with one and two - family residences. The preliminary Land Use Guide Plan indicates that this area should eventually be developed with multi -type residential use. The property is describdd,as Lots 1 thru 15 inclu- sive, Block 1, Whitney's Rearrangement. The property has been zoned "A" Residence since the adoption of the Ordinance in 1922. On July 16, 1959, the Commissioner of Finance reported the petition sufficient with the owners of'66 2/3go (20 out of 30) tracts of land within the prescribed 100 foot radius having signed the petition. At the present time, Lots 1 thru 4 are developed with a single - family residence which was constructed in 1948, and Lots 5 thru 15 inclusive are vacant. The applicant proposes to develop the vacant lots with three 17 -unit apartment buildings, with off- street parking accessory thereto for 51 car spaces, leaving Lots 1 thru 4 for single-family use. The proposed development meets the recommended standards for density and building ground coverage. The property under consideration has a frontage of 600.4 feet along Norfolk Avenue and a frontage of 127 feet along both Wheeler and Davern Streets, resulting in a total area of 76,250.8 square feet, or 1.75 acres. The proposed apartment site will involve the westerly 440 feet of the Norfolk Avenue frontage, or an area of 55,880 square feet which is 1.28 acres. North across Norfolk Avenue are six single - family residences fronting along Norfolk Avenue; south across an unimproved alley is the Remington -Rand employee parking lot; east across Davern Street is vacant land which is zoned Light Industrial; west and across south Wheeler Street is a single - family residence fronting along Norfolk Avenue, diagonally across the intersection of Norfolk Avenue and Davern Street is unimproved land which is zoned commercial. Field investigation discloses that the reclassification of this property from "A" to "C" Residence would not be detrimental to the adjoining properties. The pro- posed apartment building would provide a transitional use between the existing single - family residences now fronting on Norfolk Avenue, and the Remington -Rand plant to the south. The triangular area which is directly to the north of the property under consideration and is bounded by West Seventh Street, Davern Street, and Norfolk Avenue, is presently developed with a mixture of uses. The West Seventh Street frontage is basically commercial, and the remainder of this tract is de- veloped with one and two - family residences. The preliminary Land Use Guide Plan indicates that this area should eventually be developed with multi -type residential use. The property is described as Lots 5, 6, 7, Block 2, L. T. Lawton's Subdivision of Lot 8, Kerwin's Outlots. The zoning is "A" Residence and has been since the adoption of the ordinance in 1922. When the original petition was filed, the petitioner was asking for the rezoning of Lots 5, 6, 73, 8, 9, Block 2, L. T. Lawton'sSubdivision of Lot 8, and -the Commissioner of Finance on June 10, 1959, reported the petition sufficient with 9070 (20 of 22) of the owners of property within the prescribed 100 foot radius having signed the petition. However, when the matter was reviewed by the Board of Zoning, it was re- commended that he reduce the size of the area to be reclassified to include only Lots 5, 6, and.7, Block 2, L. T. Lawton's Sub. of Lot 8, Kerwin's Outlots. On September 1, 1959, the petitioner filed a letter with the City Clerk asking that the original petition be amended so as to include only these three lots. On September 2, 1959, the Commissioner of Finance reported the amended petition sufficient, with 94.770 (18 out of 19) of the owners of property within the prescribed 100 foot radius having signed the petition. The site is presently vacant and undeveloped, and the petitioner proposes to develop the site with an apartment building. This tract has a frontage of 120 feet along Iowa Avenue and a depth of 126 feet, resulting in an area of approximately 15,120 square feet. North and across Iowa Avenue is vacant land owned by the applicant which is zoned commer- cial; west and adjoining is vacant land, farther west are single - family residences fronting on Iowa Avenue; south and across an alley is vacant land which fronts on Hoyt Avenue; east and adjoining is vacant commercially zoned land, owned by the applicant; farther east at the southwest corner of White Bear and Iowa Avenues is a filling station. Field investigation discloses no basic objection as-it is felt that an apartment devel- opment on the property under consideration would serve as a transitional use between the single - family residences to the south and west, and the commercial development to the east which fronts on White Bear Avenue, and the commercially zoned property to the north which the petitioner advises us will soon be developed. The property to the north was considered for some time as a possible elementary school site, but has now been re- leased. The petitioner has indicated that he will develop the lots to the west with single - family residences. The reclassification of this property would not deviate from the purpose and intent of the Ordinance, nor would it be detrimental to the adjoining• property owners. The Board of Zoning considered this matter at their meeting of August 27, 1959, but there was a tie vote on the motion for approval of the reclassification of the above described property, consequently there is no recommendation from the Board in this matter. � Sincerely, • /i Herbert C.
