Whereas, the Board of Water Commissioners has established charges for water
provided to its customers, which charges have been approved by resolution of the City
Council; and
Whereas, the City Council has established sewer service charges and has provided that
such chazges be collected by the Board together with water charges, and has also
established that late charges be applied to water and sewer service chaxges that are not
paid within thirty (30) days of the billing date; and

Whereas, the current late charges, as established by Council Resolution No 94-1304,
aze in differing amounts depending on the amount of the delinquent payment, and do
not apply to interdepartmental City of Saint Paul water and sewer billings; and
Whereas, the Boazd on September 8, 2009 adopted Resolution No. 7045, which
proposed that a late charge of 5% be applied consistently to water and sewer service
charges that are not paid within thirty (30) days of the billing date, without regard to the
amount of the delinquent payment, that the exceprion for interdepartmental City of
Saint Paul billings be eliminated, and that the City Council be asked to concur with said
proposal; azid
Whereas, the Council has considered the Board's proposal and testimony received at a
public heazing, notice of which was published in a newspaper of general clrculation not
less than ten (10) days prior thereto; now therefore, be it
RESOLVED, that the City Council does hereby concur with the Board of Water
Commissioners recommendation for water and sewer billing late charges, and does
hereby establish that a late charge of five percent (5°to) be imposed upon all water and
sewer service charges which are not paid within thirty (30) days of the billing date, with
the following exceptions to be applied in accordance with established guidelines:
Late charge on a domestic account may be waived in the event of a
change in property ownership, provided the late charge is the resuit of
non-payment by the previous owner.

Water and Sewer Late Charges
October 16, 2009
Proposed language:
A late charge of 5% shail be applied to water and sewer service charges
not paid within thirty (30) days of the billing date.
The following eacceptions shall be appiied in accordance with established guidelines:
Late charge on a domestic account may be waived in the event of a
change in property ownership, and if the late charge is the result of
non-payment by the previous owner.
Late charge of up to $50 on a domestic account may be waived
one time for each account.
Late charge of up to $100 on a commercial account may be waived
one time for each account.
" Exceptions: Late charge shall not be applied to interdepartmental
City of Saint Paul sewer and water billings.
** Late charge shall not app�y to previous residential owner billings,
s�ch as speciai bi�ls, in accordance with estabfished guideiines.
5% late charge of up to $50 shall not be collected on a
residential account for a one-time delinquency occurrence for each
account, in accordance with establ+shed guidelines.
** 5% late charge of up to $100 shall not be coliected on a
commercial account for a one-time delinquency occurrence for each
account, in accordance with established guidelines.

The current 5% late chazge is capped at certain amounts and does not apply to St. Paul interoffice billings. The Boazd of Water
Commissioners desires to apply a straight 5% chazge regazdless of amount and to remove the St. Paul exemprion.
