Council City of Saint Paul Dear Council Members: You referred to this office for recommendation the request of Emmaus Lutheran Church for permit to extend the canopy for the entrance walk over the public sidewalk to the front curb on the south side of Idaho between Lexington and Ox- ford. This type is not permitted under the Building Code. It al- so would break the building line and would require an appli- cation for breaking the building line to be referred to the Board of Zoning and then referred back to the Council. The property is described as Lots 1 and 2,'ex- cept the south 63.5 feet, Block 8; Como Addition. The zoning is "A" Residence and has been since the adoption of the Ordinance in 1922. At present, there is a church structure on this property which was erected in 1949, and the applicant proposes to enlarge the structure to accomodate approximately 800 worshippers, plus Sunday school facilities, as shown on the architect's plan, a copy of which is attached. The church property includes the entire frontage along the south tide of Idaho Avenue between Lexington Avenue and Oxford Street which is approxi- mately 508 feet, and a frontage along both Lexington Avenue and Oxford Street of approximately 133 feet, resulting in an approximate area of 67,564 square feet or 1.55 acres. This includes the parking lot and play areas. The existing building line along Idaho Avenue as established by the Zoning Code is 27 feet. The applicant is requesting that a 20 foot building line be established along Idaho Avenue for the main church structure. He is also asking that a building line of zero (0) feet be granted on the east,20 feet of the west 146 feet of this site so that a canopy may be built- from the church structure to the Idaho property line. The ultimate plan�`of this church plant also requires a relaxation in the re- quired set back from the south property I ne. However, this is not being considered at this time. / The entire surrounding area is developed with single family residences. Field investi- gation discloses no objection to the 20 foot building line for the main church structure. However, the requested building line of zero (0) feet for the canopy is not desirable as it will establish an undesirable precedent. It is felt that if a canopy is necessary for coverage to and from cars, one could be erected with a set back of 12 feet and a circular drive within the church property. This drive would provide reservoir space off the street for cars waiting to load or unload passengers.
