WHEREAS, the City of Saint Paul is the Responsible Government Unit (RGi� for environmental review of the
proposed University of Saint Thomas Anderson Student Center; and
WfIEREAS, the wst foz contracting with a consultant to perform said environmental review is si�ificant; and
WFIEREAS, the environmental review process will be supervised and directed by Department of Planning and
Economic Development staff; and
WIIEREAS, the University of Saint Thomas has agreed to provide as a donation to the City, funds in the amount of
$71,955 to cover the costs of the environmental review; and
WHEREAS, the Mayor, pursuant to Secrion 10.70.1 of the Charter of the City of Saint Paul, does hereby certify
$71,955 in funds are available for appropriation in excess of those estimated in the 2009 budget and recommends the following
changes to the 2004 budget:

Action Requested:
Approval of resolution authorizing budget amendment. Amended budget will accept donation in amount of $71,955 from the
University of Saint Thomas, with all funds directed to contract with SRF Consulting for environmental review of a proposed building
project on the Universiry of Saint Thomas campus. PED staff will be directing the work of SRF Consulting.

Initiating Problem, Issues, Opportunity (Who, What, When, Where, Why):
University of Saint Thomas has proposed the construction of a new student center to 6e located at the northeast cornet of the
intersection of Cretin and Summit Avenues. As the new building will be located partially in the Summit Avenue West Historic
Distnct, Minnesota law requires that an Environmental Assessment Worksheet (EAW) be completed. Through an RFP process
involving both City staff and representatives from the West Summit Neighborhood Advisory Committee (WSNAC), SRF Consulting
was chose to complete the EAW. The University of Saint Thomas will provide funds to cover the cost of the services to be provided
by SRF; SRF will be under contract too and work at the direcrion of the Ciry, managed by PED staff.
Advantages If Approved:
Reyuired environmental review work may proceed. Budget amendment will allow University of Saint Thomas to pay for costs of
environmental review while still maintaining full control for the Ciry of Saint Paul as the Responsible Govemment Unit (RGLn under
state ]aw.

If not approved, one of the following undesirable situations would result. 1) Environmental review work proceeds, but altemate Ciry
funds would be required to wver costs; or 2) Environmental review work procees, but with consultant under contract to University of
Saint Thomas, resulting in tainting of process and undermining of Ciry's Lole as RGU; or 3) Environmental review wozk cannot
proceed.
