Dear Sir:
This is in the matter of the appeal of Revel -end Paul Engstrom, Messrs.
Eugene Morrison, Robert V. Peterson, and Bernard J. Vogelgesang to establish
a building line which differs from the one established in accordance with
the provisions of Chapter 62 of the Zoning Code. The property is located on
the west side of Winthrop Street ,between Boxwood Avenue and Snowshoe Lane.
The legal description iss Lots 1 through 4 inclusive, Block 2, Lewiston
Heights Addition. The present zoning is "All Residence and has been since
1922. -
The properties are presently undeveloped, and if the appeal is granted the
Applicants propose to develop each lot with a single family residence.
The present building line as established by the Zoning Code is 57 feet which
is an average of setbacks varying from 51 -feet to 63 feet. There are
private covenants which run with the lots in Lewiston Heights, one of which
establishes a 35 foot building line for the lots under consideration. The
owners of-the majority of the lots in Lewiston Heights Addition, 21 of a
possible 26 lots., have consented to waive the 35 foot building set back line
in lieu of a 25 foot set back. The four lots combined have a frontage of
638.12 feet along Winthrop Street and an average depth of 264 feet'producing
an area of approximately 158,150 square feet. The adjacent land uses are as
follows: north and adjacent a small residence which is approximately 150
feet north of the north line of property under consideration; west and
adjoining, undeveloped land with the exception of one single family residence
which fronts on Highway 61; south and adjoining vacant land; east across
ungraded Withrop Street undeveloped land. At present, this area is sparsely
developed.
Field investigation and a review of the appeal by the Board of Zoning and
its staff reveal that due to the topography of the property under consider-
ation and adjoining properties, it would be very difficult to comply with
the established building line, and that the set back line presents_ an undue(
hardship. It is the opinion of the Board that the appeal for a change in
the set back would in no way be detrimental to adjoining properties nor
would it deviate from the purpose and intent of the Zoning Code.
In consideration of the above factors, the Board of Zoning recommends that
the appeal to establish a 25 foot building line for the property under
consideration be granted.

We have seen the scale drawing of the house which Mr.
Paul Engstrom intends to build on the lot next to ours.
We approve of this location and are enclosing a
plat showing that location and have initialed this plat
to indicate our approval.
Since the topography of our lot is similar to that
of Mr. Engstrom's we are requesting a 25 foot building
line for the area west of Winthrop Street.

This appeal is also based on Section 62.09 which provides:
"Where= in any block or portion of a block there are lots not of
uniform depths, of irregular shapes or peculiar proportions -Yo

er Shall be relaxed to the extent necess
to prevent undue or peculiar hardship.'
Whereas the lot on which we hope to build has an average depth
of 263.4 feet, a substantial portion of this lot is unusable because
it dtopes off in a 45 degree slope. The usable portion comes to a
point about 140 feet west of the street line. Thus, if this appeal
is granted and our building line can be-established at 25 feet west
of the street line, we will have for our back yard an attractive knoll
which will extend about 60 feet west of our walkout basement before it
drops off in a steep slope. If,however, this appeal is not granted,
and we must comply with the 20% requirement of Section 62.01, then we
will lose most of our back yard.
This will render our present house plan useless. Wexhave under-
gone considerable expense hiring an-architect. The house was designed
specifically to take advantage of the above - mentioned- knell. If we
are required to set the building line at 52 feet (20% of average lot
length) west of the street-line instead of the requested 25 feet, we
will havoto abandon our plan to build on this lot. I say this because
the adequacy of a back lot is, for our family purposes, all-important.
To locate our home closer to the road and farther from the bluffcwill
make possible for us three vitally important conditions: 1) the safety
of a back yard play area away from the road, 2) the privacy and
utility of a back yard for such purposes as hanging clothes, gardening,
picnicking, etc., 3)an unobstructed view of Pig's Eye Lake, the
Mississippi River Valley, and the St Paul sky -line. If we were to

locate the house as provided in Section 62.010 the primary view
from our picture window would be Highway 61 and a concatenation
of railroad tracks below.

You wilVobserve from -the attached drawing that, according to
our request, only the southeast corner of the garage will be
located 25 feet from the street line. The main body of the house
will be located at a greater distance from the_ road because it (the
house) angles to the southwest..
The north and south loth: lines present no problem. The house
will be located an adequate distance from them.
The majority. of the property owners in the surrounding area
.have expressed approval of this appeal.

As owner of Lot 4, Block 2, Lewiston Heights, Saint Paul,
I would like to express my approval of Paul Engstromts appeal
to you for a 25 foot building line west of Winthrop Street. I
have seen his scale drawing of the plat and his planned house
location. I approve of this location. His lot is right next
to mine. The unusual contour of the land means that he would
suffer hardship by complying with the 20% rule.
This is also true in my case. I would like,to have the
City Councilts permission to establish my building line at 25
feet west of_the street line.
