March 25, 1959 i Honourable Mayor and City Council Building Dear Council Members: Mr. Louis P. Sheahan, Corporation'Counsel, recently furnished this office with a copy of the following. bill: ' S. F_, NO. 965 FOR AN ACT RELATING TO ZONING. IN CITIES OF THE FIRST CLASS; AMENDING MINNESOTA STATUTES 1957, SECTION 462.18. This,bill has been introduced in the current session of the Minnesota State Legislature. - The proposed change would' reduce the number of signatures required on consent petitions from the present two - thirds of the owners of real estate within a 100 foot radius of the affected property to a simple majority of the property owners.abutting the-affected property.° The Zoning Board considered this proposed -change of the Statutes at it's last regular meeting held on March 19, 1959, and was unanimously opposed to it's enactment. Amongst the reasons�,cited for the stand were: (1) It. would make it far too easy to rezone property; (2) It is quite possible that,in many cases, the petitioner could own enough abutting property to be able to sign his own petition and achieve sufficiency on this basis; (3) It would add tremendously to-the work load of the Zoning Board, the City Architect, and the City Council in processing these petitions, many of which undoubtedly would have to be denied. y The Board of Zoning respectfully requests the City Council to oppose the passage of this amendment, or to have the City of St. Paul excluded from it's coverage.
