Presented by
1 WHEREAS, adverse action was taken against all licenses held by Blue Chip Tree Company, Inc.,
2 d/b/a Blue Chip Tree Company (License ID#0078987) for the City of Saint Paul by Notice of Intent to
3 Suspend Licenses dated September 30, 2009, alleging licensee failed to pay delinquent license and late fees
4 in the amount of $482.00 and submit requested insurance and vehicle information; and
5
6 WF3EREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office recommended
7 license suspension and a$500.00 matrix penalty; and
9 WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to pay the
10 delinquent license and late fees, the $500.00 matrix penalty and submit the requested insurance and vehicle
11 information; and

13 WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to pay the
14 delinquent license and late fees, the $500.00 matrix penalty and submit the requested insurance and vehicle
15 information by October 9, 2009, that the matter would be placed on the consent agenda to impose the
16 recommended penalty; now, therefore, be it

18 RESOLVED, that all licenses held by Blue Chip Tree Company, Inc., d/b/a Blue Chip Tree
19 Company are hereby suspended for failure to pay delinquent license and late fees.

21 FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to
22 submit requested insurance and vehicle information. Payment of such penalty shall be made within thirty
23 days of the date of the adoption of this resolution.

Dear Sir/Madam:
The Depaztment of Safety and Inspections (DSI) has recommended suspension of a111icenses held by Blue Chip
Tree Company, Inc. d/b/a Blue Chip Tree Company for the City of Saint Paul. The basis for the recommendation is as
follows:
On August A, 2009, you were sent a letter and RENEWAL INVOICE from the Departrnent of
Safety and Inspections (DSI) stating that your Tree Trimmer & 1 Vehicle and Tree Trimmer —
Each Additional Vehicle licenses were delinquent. As of today's date you now owe $482.00 in
license and late fees. You were also asked to submit a current certificate of General Liability
insurance and current vehicle information (year, make, model and license plates).
You were given until August 25, 2009 to pay the delinquent license and late fees and submit the
requested information. As of today's date, neither the payment nor the requested inforanation
has been received.
In addition to the suspension of your licenses, per Saint Paul Legislative Code §310.05 (m) (2), the licensing
office will also recommend a$500.00 matrix penalty for failure to submit required information in order to maintain
yourlicense.
At this time, you have three op6ons on how to proceed:
You can pay the delinquent license and late fees, the $500.00 matrix penalty and submit the requested
informa6on. If this is your choice, you should send the payments and requested information directly to the
Department of Safety and Inspections, at 375 Jackson Street, Ste. 220, St Paul, M'snnesota 55101-1806 no
later than Friday, October 9, 2009. Information should be directed to the attention of Christine Rozek. A
self-addressed envelope is enclosed for your convenience. Payment of the delinquent license and late fees,
matrix penalty and submission of the requested information will be considered to be a waiver of the
hearing to which you aze entitled.

2• If you wish to adrrit the facu but contest the penalry, you may have a public hearing before the Saint Faul
City Council, you wi11 need to send me a letter with a statement admitting the facts and requesung a public
hearing. We will need to receive your letter by Friday, October 9, 2009. The matter will then be
scheduled before the City Council for a public hearing to determine whether to suspend your licenses and
impose the $SOO.OQ matrix penalry. You will have an opportunity to appeu before the Council and make a
statement on your own behalf.
3. If you no longer wish to do business in ti�e City of Saint Paul, you will need to send a written statement to
that effect to the Department of Safety and Inspecrions, at 375 Jackson Street, Ste. 220, St. Paul,
Minnesota 55101-1806 no later than Friday, October 9, 2009. InFormation should be directed to the
attention of Christine Rozek.
If you have not contacted me by that date, I will assume that you do not contest the suspension of
your licenses and imposition of the $500.00 matrix penalty. In that case, the matter witl be placed on the
City Couucil Consent Agenda for approval of 4he recommended penalty.
