MINNIIOTA rah i February 26, 1959 Mr. Joseph Okoneski City Clerk Building (Revision of previous letter dated 1/29/59) Dear Sir: This is in the matter of the application of Schillers Inc. for a permit to install and operate -a 43 car parking lot, and to relax the eight foot side yard buffer to four feet, with adequate screen planting, from the south side of Lot 50, and the -front `yard set back from fifteen feet to ten feet on pro- perty located on the east side of Dale Street between Nebraska and Arlington Avenues. The legal description is as follows: except the northerly 22.8 feet, Lot 46 and all of Lots 47, 48, 49,and 50, Danforth Park. The original zoning was "A" Residence, and the property was rezoned to Commercial on November 28, 1946 .. On October 25, 1954, an application for a customer parking lot was made by the Harbill Company. This application was later withdrawn by letter dated July 26, 1955. Since that date, the property was sold to the applicant, Schillers Inc. This property is presently developed with a parking lot which is accessory to an existing supermarket. However, the parking lot bas,been operated without a permit, and the applicant proposes to correct this situation. The frontage of the entire site including the parking lot is 177.2 feet along Dale Street extending to a depth of 129.5 feet, giving an area of approximately 22,947 square feet. The adjacent land uses are as follows: south and adjoining is a single family two -story brick residence fronting on Dale Street; farther south are four single family residences also fronting on Dale Street; north and adjoining is the existing supermarket, and adjoining the supermarket on the north is a hardware store with an apartment on the second floor; east across a graded alley is vacant, undeveloped land owned by the applicant; west across Dale Street are the Elmhurst Greenhouses and a single family residence, all front- ing on Dale Street. The Traffic Engineer approved the plan as submitted on December 18, 1958. The proposed parking lot meets the required standards for this type of faci'- lity with exceptions as follows: the applicant proposes to reduce the required eight foot side yard buffer to four feet with adequate screen planting, and the front yard set back of fifteen feet to ten feet. Field investigation discloses that the proposal appears to be non - detrimental to the adjoining property owners. c In consideration of the above factors, the Board of Zoning recommends these two request be granted in accordance with plans approved December 18, 1958.
