1 WHEREAS, the City of Saint Paul, Division of Pazks and Recreation (the "City") owns park land
2 known as the Valley Recreation Center Boys & Gitls Club (the "Valley Property"), which is located at 690

WHEREAS, Gillette Children's Specialty Healthcare ("Gillette") has requested the diversion of a
portion of the Valley Property to construct a new building on Gillette's adjoining properry at 183
University Avenue East, as depicted on the drawing attached hereto as Attachment A, a copy of which is
on file in the Office of Financial Services, Real Estate Section, in the file number 07-PKLDVRS-2009; and
WHEREAS, the Saint Paul Pazks and Recreation Commission supports the diversion of the Park
Properiy, as stated in its resolution, Number 09-I5, adopted September 9, 2009, a copy of which is
attached hereto; and
WHEREAS, the City recommends granting to Gillette a 15,000 squaze foot temporary construction
easement and a 72,000 square foot permanent easement over the Valley Property, and Gillette has agreed
to pay just compensation as deternuned by an independent appraisal pursuant to Section 13 A 1.1 of the
Saint Paul City Charter; now, therefote be it
RESOLVED, that the ptopec city officials aze hereby authorized and dixected to grant to Gillette
said temporary and permanent easements over said Valley Properiy; and to accept just compensation from
Gillette in the form of cash to be deposited into the Parkland Replacement Fund and held in reserve for
fixture purchase of park property as required in Chapter 13.Q 1.1 of the City Charter; and that all fees
required by the City to comply with its parkland diversion guidelines shall be ful]y compensated by
Gillette.

Giliette Clilidren's Specialty Healthcare plans to construct a new builidng on vacant land it owns immediately east of 183 E.
Univeisity Ave. The north wall of the property would abut the existing bluff and would need to be secured to the bluff via Geback
cables. The cables would be located beneath the surface of the pazk land and the surface would not be disturbed.

The City may divert park property (via a subswface easement) that is unusable for progranuning, and receive funding for future
pazkland pucchases.

RESOLUTION 09-15
WHEREAS, the Saint Paul Pazks and Recreation Comrnission ("Conunission"} is an appointed
body established to advise the Mayor and City Council on long-range and cit}nvide matters related to Pazks
and Recreatian; and
WHEREAS, Section 13.01.1 of the City Charter requires that the Commission review any
diversion or disposal of park property and present a recommendarion to the Saint Paul City Council; and
VJI�EREAS, the City of Saint Paul, Division of Parks and Recreation, ovms pazk property lcnown
as the Mount Airy Boys and Girls Ciub / Valley Recreation Center ("Rec Center") located at 690 Jackson
Street; and
WHEREAS, Gillette Children's Specialty Healthcare ("Gillette") owns land adjacent to the Rec
Center property at 183 University Avenue East and has requested the diversion of more than 72,000
squue feet of the Rec Center property for access, soil tesring, construction and a post-construcrion
permanent easement for an underground cahle tie-back system in connection with fl�e proposed
construction of a 3-story office Uuilding to be tocated east of the current Gitlette facility (as shown on
Attachments A-1 through A-S); and
WHEREAS, die Division of Parl;s and Recreation ("Parks & Red'), the Saint Paul Boys and Girls
Club and d�e Saint Paul School IIistrict have met with Gillette and reviewed the proposed access route (A-
1), soii boring locations (A-1), temporary construcrion access area (A-2), permanent easement azeas (A-3),
temporary easement safety plan (A13), tie-back cable schematic drawings (A-5) and tree pcotecrion and
restoration p]an, and have deternuned that the Rec Center property may be diverted for these purposes;
and
WHEREAS, Pazl;s & Rec recommends that the Commission suppon Gillette's request as
described above and in Attachment A; now, therefore
BE IT RESOLVED, that the Saint Paul Parks and Recreation Commission concurs with the
request for permission to divert city pazk land at 690 Jackson Street, granted via right-of-enhy permit,
temporary construction easement, and permanent easement, to Gi3lette Children's Specialry Healthcaze,
and in accordance wich C1ty Charter Section 13.07.1 recommends approval by the Saint Paul Ciry Council.

I recommend a public hearing before the City Council be held on October 21, 2009.
The purpose of this hearing is to consider a resolution to authorize the diversion of
city park land for Gillette Children's Specialty Healthcare for a permanent easement
over a portion of the Valley Recreation Center Boys & Girls Club property, 690
Jackson Street, for the purpose of constructing a new building at 183 University
Avenue East.
