WHEREAS, the Cify of Saint Paul. Police Department has been awarded the 2009 Edward Byme Memorial Justice
Assistance Grant (Attachment A): and
WHEREAS, the city council has authorized the City of Samt Paul, Police Department to enter into the attached agreement on
August 5, 2009 (council file #09-R35) with [he United States Departmen[ of Justice, and
WHEREAS, this grant proaides funds to support ali components of flie criminal justice system, from multi jurisdictional
drug and gang task forces to crime prevention and domestic violence programs, courts, corzections, treatment and justice
information sharing initiatives; end
WHEREAS, the City of Saint Paul, servm� as the fiscal agent for th�s award, will share the grant funds with two disparate
jurisdictions witlun R3msey Coonty, and
WHEREAS, eacli j��risdiction's all�cat�on will be used for activities and projects that will provide meaningful and
measurable outcomes consistent witl� tlie goaLs of the grar.t;
WHEREAS, a 2009 f:nancmg and spendmg p1an needs to be established for these funds; and
WHEREAS, the Mayor �ursuant to Section 10.07.1 of the Charter of the City of Saint Paul, does certify that there are
available for appropriation fvnds of $15Q000 in ezcess of Lhose estimated in the 2009 budget; and
WHEREAS, the Mayor recommends fliat the follounng addition be made to the 2009 budget:

The grantee agrees to assist BTA in compiying with [he Nationat Environmenta! Policy Act (NEPA), the Narional
Historic Preservation pct, and other related federal env�ronmental impact analyses requirements in the use of [hese
Srarrt funds, either d�rectly by the gantee or by a subgan[ee, qccordingly, the grentee agrees to first de[ermine if any
of the following ac[ivit�es wiil be funded by the grant, prior W obl�ga6ng funds fot any of these purposes. If it is
detertnmed that any of the following ac4vfies will be fwided by the grant, [he grantee agrees [o contact BIA.
The grancee underscands tt�at this speciat condition applies to its following new ac6vifies whether or not they are being
speafically funded with [hese grant funds. That is, u long as Ihe activity is being co�ducted by the grantee, a
sub�antee, or any third party and the uhviry needs tn 6e undertaken in otder to use these grant funds, [his special
condrtion must firs[ be met. The activides covered by [his special condition aze:

idrntifica(ion, seizure, or closure of dandestine metharnphetamine labocatories.
The gran[ee understands and agrees that complymg with NEPA may require the prepara[ion of an Environmenta(
Assessment and/or an Environmental Impact Statement, as dimcteA by BJA. The gantee fur[her understands and
agrees to the requiremen[s for implementa4on of a Mitigation Plan, as detailed at
http;//www.ojp.usdoj.govBJA/resource/nepahhnl, for programs relati�g to methamphetamine laboratory operatio�s.
Application of This Speaal Condition to Grantee's Erzishng progryms or Activities: For any of the grantee's or its
subgrantees' ex�sting programs or actrvities that will be fwided by these gmnt funds, the gran[ee, upon spec$ic request
&om BJA, agrees to cooperate with B)A m any preparation by BJA ofa national or program emironmental assessment
of that fimded program or activity.
7. To avoid duplicating existing nehvorks of I7' systems in any iniGatives funded by BJA for law enforcement information
shanng systems which involve mtersta[e connectivity between junsdichoq such systems shall employ, to the extem
possible, �isting networks as Ne communicatio� backbone to achieve interstate connectivity, unless the grantee can
demonstrate to [he satisfaction of BJA tha[ [his requirement would not be wst effective or would impair the
functionahty of an exis[ing or proposed [T' system.
8. To support public safety and�ustice infortnation shazi�g, OIP requires the gantee to use the National Infottnafion
Exchange Model (NIE� speci8cations aud guidelinea for t6is particulaz grant Graptee shall publish and make
available vrithout resmction alI schemas generated as a result of this grant to the wmponent reg�say as specified in the

9. The recipient is required to establish a tn�st fund account (The trust Tund may or may not be an interest-beanng
account.) The fund, i�cluding any interest, may �ot be used to pay debts or expenses mcurzed 6y other ac6vifies beyond
the scope of the Edward gyme Memoriallustice AssisTance Grant Progam (JAG). The ruipient also agrees to obligate
and expend [he grm�[ fuuds 9p tbe Vust fund (mcl�ding any interest eamed) during [he period of the grant. Grant fimds
(including any mterest eamed) not expended by the end of the grnnt period must be retumed ro the Bureau of Justice
Ass�stance no la[er than 90 days after the end of the grant penod, along with the final submission of the Financial

C.F.R. Part 23, Criminal fntelligence Sysiems Operating Policies, if 03P determmes ihis regulation to be applicabie.
Should OJP detertnine 28 C.F.R. Part 23 to be applicable, OJP may, at iLS disaetion, pedortn aud2s of the system, as
per the regulation. Should any violation of 28 C.F.R. Part 23 occur, the recipient may be fined as per 42 U.S.C.
3989g(c}(d). Recipient may not satisfy suc6 a fine witfi federal funds.
12 The recipient agcees to ensure Ihat the State Informatlon Techuology Point of Contact receives wcitten no[ification
regarding any infortnation tech�ology pro�ect funded by th�s grau[ during the obligafion and expeuditure period. This is

I3. The grantee agrees to comply w�th the applicabte requiremenGS of 28 C.F.R. Part 38, the Depar[ment of Jus[ice
regulafion goveming "Equal Treatment for Faith Based Organiza4ons" (the "Equal Treahnent Regulation").'fhe Equal
Treatment Regula4on provides in part that Department of Jusfice grant awazds of direct fundmg may not be used to
fund any �nherentty religious actrvities, such as worship, rel��ous insWCfion, or proselytization. Recipients oPdirect
grants may still engage in inherently religious activi0es, but such activities must be sepazate in hme or place from the
Departrnent of Justice Ponded program, and participation m such activiUes by individuais receiving services Gom the
grantee or a sub-grantee must be voluntary. The Fqual Treahnent Regulation also makes cleaz that organiaations
participating in programs directly funded by [he Departrnent of Justice are not pertvtted [o discriminate in the prov�sion
of services on the basis of a beneficiary's religion. Notwithstanding any other speaal condition of this award, faith-

The Edward Byme Memorial Justice Assistance Grant Progtam (JAG) allows states and local
govemments to support a broad range of activities to prevent and contro] crime and [o improve the
criminal justice system, some of which couVd have environmental impacts. AII recipients of JAG funding
must assist BJA in complying wi[h NEPA and other related federal environmental impac[ analyses
requirements in the use of grant funds, whether the funds are used direct3y by the grantee or by a
subgrantee or third party. Accordingly, prior to obligating funds for any of the specified activities, the
grantee must first determine if any of the specified activities wilt be funded by the grant.
The specified activities requiring envirotunental analysis aze:
a. New construcfion;
b. Any renovation or remodeling of a property located in an environmentally or historically sensitive
area, including properties located within a] 00-year flood plain, a wetland, or habitat for endangered
species, or a properiy listed on or eligible for listing on the National Register of Historic Places;
c, A renovarion, lease, or any ptoposed use of a building or facility that wili either (a) result in a change
in its basic prior use or (b) sigpificantly change its size;
d. Implementation of a new program involving the use of chemicals other than chemicals that are (a)
purchased as an incidental component of a funded activity and (b) traditionally used, for example, in
office, household, recreational, or education environments; and
e. Implementation of a program relating to clandestine methamphetamine laboratory operations,
including the iden[ificatioq seizure, or dosure of clandestine methamphetamine laboratories.
Comply�ng with NEPA may require the preparation of an Environmental Assessment and/or an
Environmental Impact Statement, as directed by BJA. Further, for programs relating tn
methamphetamine laboratory operations, the preparation of a detailed Mitigaqon Plan will be required.

to treat these organi�a4ons the same as any other applicant or recipient The regulation prohibits State Admmistering Agencies from making
award or grant administration decis�ons on [he basis of an organi�ahods reLigious chazacter or a�hation, ce(igious name, or the rel�gious

The regulahon also prohibits faith-based orgamzations from using financiat assistance &om the Deparlment of Jushce to fund inherent(y

The Ramsey County Sheriffs office proposes utilizing its JAG allocation to fund overtime
for the Gang Unit. The iniriatives under[aken with these funds will include gang
identificarion efforts, warrant sweeps that target the most violent offenders, and
concentrated enforcement and surveillance activities aimed at repeat offenders. The
Ramsey County Sheriff and Saint Paul operate a joint narcotics effort utilizing Byrne
Grant funds in Ramsey County. These funds will augment these efforts.
Proposed expenditure of funds - Overtime $51,866
Ramsev Countv Corrections
The JAG funds will be used to support a community conections aide. The aide supports
the ovetall work of the intake unit by performing criminal record checks on violent
offenders refexred by the courts of Ramsey County. Ramsey County Conections handles
corrections for all of Ramsey County including the cities of Maplewood, Roseville, and
5aint Paul. The position determines the custodial status and length of stay in the local jail
for referred offenders. The position is responsible for entering new case information into
the automated data base and conducting data integrity operations. In addition, the

individual gathers and collates such information as is appropriate relative to cases placed
under correctional supervision for dissemination to the probation officer assigned to the
case.

Ramsev Countv Attornev's Office
The Ramsey County Attomey's Office in cooperation the Ramsey County Courts has
initiated ongoing meetings with criminal justice representatives to deal with the issues
surrounding cases invoiving guns, gangs and violent crimes. The Ramsey Council
Attorney's office is the chief prosecuting agency for all of Ramsey County including the
cities of Maplewood, Roseville and the City of Saint Paul. One of the key issues
idenrified was the need for the court to have more complete information on defendants
prior to decisions on bail and sentencing. Law enforcement officers, and particularly
those who work with the Minnesota Gang Strike Force, are in possession of necessary
and useful information but aze not usually present at court hearings. An invesrigator has
been hired to work closely with Federal, State, and local law enforcement agencies to
insure full access to essential information from those agencies to special gang prosecutors
and all other adult and juvenile prosecutors.
Proposed expenditure of funds - Salaries $ 32,757
Citv of Maplewood
The Maplewood Police Department intends to use its share of the 2009 JAG money awarded to
St. Paul and Ramsey County to assist the Depaxtment in funding officers assigned to the Metro
Gang Strike Farce and the East Metro Narcotics Task Force.
As of January 1, 2007, the Gang Sh Force position was filled far the first time in the history
of the Department and the Narcotics Officer position was filled for the first time in many years.
These positions are funded, in part, by grants tiuough the State of Minnesota Office of 3ustice
Programs. This funding a total of $90,000 for both positions, does not cover the total cost of
these officers. The additional fixnding through the JACT program will help defray the cost of
having officers assigned to the responsibility of combating gang violence and narcorics activity an
the City of Maplewood. Both of these issues continue to grow in Maplewood and through the
assigrunent of officers dedicated to the tasks, a mare concentrated effort is able to be made.
The Metro Gang Strike Force funding is at risk of being cut as of 7uly 1, 2009. Dealing with
gang violence will conrinue regardless of what happens to the funding. Maplewood plans to
continue to provide a gang officer who may work in conjunction with other local departments.
The JAG funds would be the oniy funding available for this position if the grant funding is cut

and JAG monies would be used exclusively for this position rather than split between the two
posirions.

Saint Paul Police
The Saint Paul Police Department will use a portion of the JAG to support the
following activities as needed on an overtime basis:
Focusing Our Resources On Community Empowerment (F.O.R.C.E.) Unit:
The Saint Paul Police Depariment recognizes the negative and pervasive influence that
drugs and narcotics have on the quality of life in our community. The department also
recognizes that drug use and related activities are a social phenomenon that requires a
coordinated response between police officers, residents, and the combined resources of
the City of Saint Paul. The FORCE Unit is designed to combine resources in an effort to
attack the scourge of drug use through a variety of strategies. F.O.R.C.E. Unit has found
through unit investigations that suspects in street level narcotics investigations are very
mobile, involved in other criminal activity and often create problezn properties where they
conduct their illegal activities. There is a strong need to address problem properties and
behavior throngh the use of jump-out details, agent buy operations, laiock and talk details
and search warrants. Additional emphasis needs to be directed toward block club
meetings, administrative follow-up, cooperating agency meetings and educational
presentations. High crime areas will be defined by F.O.R.C.E. based on nuxnbers of
resident complaints, concentration of problem property cases, computerized mapping and
intelligence information generated by patrol officers and informants.
Anticipated Goals/Outcome: Address crime hot spots citywide, to reduce street level
narcotics activity, associated crimes, and problem properties in the target areas. Overtime
funding will strengthen the F.O.R.C.E. Unit's specialized approach to intervening Ahot
spots@ by permitting more time for coordination with neighborhood service area
supervisors, district council neighborhood crime prevention coordinator and relevant city
services such as code enforcement, fire inspections, and licensing. An increase in arrests,
drug seizures, and prosecurions will be seen as well as an increase in the quality of life for
residents of the city.
Gun Issues - Possession and Discharge of Firearms:
Trained officers retrieve illegal guns as well as document guns that have been confiscated
by utilizing gun suppression techniques.

Anticipated Goals/Outcome: Reduce the level of intentional discharge of fireanns by
intervening with violent offenders with a documented history of gun violence. Gathering
and sharing of intelligence data, training on gun interdiction techniques and use of
technology to improve communications between department resources, and law
enforcement agencies to accomplish outcome.
Narcotics/Special Investigation Unit (S.I.U)/Minnesota Gang Strike Force:
Saint Paul and its adjoining suburban communities contained within Ramsey and Dakota
Counties has experienced a large impact from the burgeoning methamphetamine problem.
Prior to 1998, St. Paul drug seizures were comprised lazgely of cocaine and marijuana
with a representation of other illegal drugs including methamphetamine. Beginning in
1998, methamphetamine seizures quickly outpaced other drug seizures by a margin of
almast 2 to 1. Saint Paul's west side community is becoming lmown as source ciry for
methamphetamine. Highly financed criminal organizations importing from Mexico,
using mostly methamphetamine distributors locally, blend into the illegal activities and
avoid prosecution. The majority of the methamphetamine coming into Saint Paul and the
Saint Paul suburban community originates from labs in California and Mexico.
In addition, the City of Saint Paul will use these grant funds to supplement the work of
the State-wide Metro Gang Strike Force. The department has six sworn personnel
assigned to this task force. Partners include the Ramsey Count� Sheriffs Office and the
Maplewood Police Department.
Anticivated GoalslOutcome: Overtime availability wiil allow officers to more thoroughly
pursue investigations related to the west side methamphetamine market resulting in an
increase in drug seizures and arrest.
Use of the funds far the gang strike force will result in more arrests, seizures, and
prosecutions.
Neighborhood Service Area (NSA)Beat Of�cers:
Neighborhood policing identifies with geographic areas within each district, which are
refened to as Neighborhood Service Areas (NSA) and beat assignments. NSAs and beat
areas incorporate well-defined neighborhoods within Saint Paul into police service areas.
Neighborhood policing brings residents, business owners, and the police officers closer
together to work on common issues that affect the quality of life and the public safety in
that neighborhood. Officers identify crime problems and take proacrive measures to
solve pubiic safety related issues with community support and assistance.

Anticipated Goals/Outcome: The program will focus overtime hours on a proactive
approach to solving problems identified by officers working in collaboration with district
councils, and both the business and community groups. Issues to address include drug
dealing, disorderly people, drunks, pickpockets and problem properties that impact
quality of life issues. In addition, those problems identified will be assigned to an officer
who will be responsible for the action and outcome. Further attention will be focused on
mulfi-housing areas. A decrease in crime in these areas is expected as well as an increase
in quality of life.
Park and Recreation Center Details:
Saint Paul recreation centers provide residents with a place in their neighborhood to learn
and have fun, and also serve as the community's gathering spot - the focus of Saint Paul's
famously strong neighborhoods. The over 1.5 million visits made annually attest to their
effecfiveness in meeting those needs. Both Saint Paul police officers and police security
rangers are involved in maintaining a safe environment for the parks.
Anticipated Goals/Outcome: To provide a safe environment in the City of Saint Paul's
parks to allow children to play and learn. Police officers can work in the parks as
mentors and youth workers allowing children to have the opportunity to enjoy activities
and to see police officers in roles outside that of the traditionai Apolice officerC. Officers
will also develop longer standing relationships with youth and park staff preventing
problems from occurring or reoccurring at the recreation centers.
Vice and Prostitution Details:
Street Prostitution in the city continues to be a problem in certain areas. The department
is committed to address the issue.
Antici�ated Goals/Outcome: The Vice Unit will strategically schedule police officers
from within the deparhnent to participate in enhanced prostitution suppression activities
without deleting their abiliry to contribute to meeting the goals of their own
organizationai units as weil as keeping the neighborhoods of Saint Paul free from street
level criminal activity.
Truancy/Curfew:
To find solutions for increased truancy and curfew violations in Saint Paul and its
surrounding suburbs, the Ramsey County Truancy and Curfew Center(RCTCC) was
established in 1994. A representative from the Saint Paul Police Deparhnent is on the
execurive committee that oversees and coordinates the collaborarive work of the RCTCC.
School Resource Officers perform these duties after school hours.

AnticiDated Goals/Dutcome: Truancy officers will be assigned during peak school hours.
Curfew sweeps will be performed several rimes per month. Curfew{Truancy violators
will be stopped and tagged so there is a decrease in school age youth present during
school times and times after curfew.

The Saint Paul Police Department wilt use approximately 10% of the 2007 JAG for
costs associated with administering JAG funds:
The Gity of Saint Paul Police Department will utilize the administrative portion of the
JAG funds to assist in distributing the funds; monitoring the award; submitting reports
including performance measure and program assessment data; and providing ongoing
assistance for any subrecipients of the funds.

The Saint Paul Police Department is a full-service police deparhnent wiCh the
infrasriucture, experience, technical expertise and commitment to implement this
collaborative project. This infrastructure includes financial management and reporting by
the accounting unit which provides planning and budget support to the divisions as well
as fiscal management of deparhnent functions. This unit is also responsible for the
coordination of the annuai operaring budget, gant accounring, supervision of internal
expenditures and internal controis including fund audits. Salaries and fringe benefits for
submitting financial reports and providing on-going financial assistance during the grant
period is 3.5% ($3010 x 4 years =$12,040) ofthe Accounting Technician ($86,075).
Salaries and fringe benefits for providing on-going assistance during the grani period is
3.5% ($1904 x years =$7616) of the Clerk Typist IV ($54,398).
The payroll unit is responsible for paying approximately 800 employees and records, T'he
unit also records and updates vacafion rime, sick rime, holiday pay, overtime, and
maintains medical record files. Salaries and fringe benefits for providing on-going
payroll assistance during the grant period is 3.5% ($2329 x 4 years =$9317)of the Payroll
Supervisor ($66,549).
Salaries and fringe benefits for dishibuting funds, monitoring the award, and providing
on-going assistance during the grant period is 3.5°lu (4144 x 4 years =$16,574)of the
Research and Grants Manager ($118,387).
The deparrinent is committed to serving the community and is organized in such a
manner as to be more responsive to the community we serve.

Police Budget Amendment to establish financing & spending plan for shaze of
2009 7ustice Assistance Grant Recovery Act Funds to be distributed to other
agencies

The attached resolution establishes a financing and spending plan for a federal law enforcement grant.
The grant is with the Department of Justice. This plan repzesents the shaze of the 2009 Jusfice
Assistance Grant (JAG) Recovery Act Funds that are to be distributed to other agencies within Ramsey
County. The total is $150,000. Because Saint Paul is the fiscal agent, we aze obligated to manage this
portion of the grant, rather than the federal government.
Because this will amend the Police budget, this will require a public hearing. It wili be on the CounciPs
agenda October 14`�`, as the first and third meetings each month are the opportunities far budget
amendments.
This proposal seems reasonable, I recommend signing.
