THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby
granted Melvin Roth and Ruth M. Roth to construct, at their own
expense, a public sanitary sewer in a ten foot wide perpetual
public easement, said sewer to extend from the intersection of
.Nebraska.Avenue and Chamber Street; thence southwesterly across
tot 3, Lake Residences, to a point that is 20 feet north of the
south line of Lot 3, Lake Residences, and 45.2 feet west of the
center line (produced) of Chamber Street as platted north of
Nebraska Avenue.
Section 2. The Commissioner of Public Works is hereby
authorized to issue a permit to said Melvin Roth and Ruth M. Roth
for the construction of said public sanitary sewer, upon their
compliance with the following conditions, viz:

1. Said permittees shall construct said
sewer entirely at their own expense, under the
supervision and to the satisfaction of the
Commissioner of Public Works, and in accordance
with plans and specifications of the City of
Saint Paul:
2.'' Saiid per'mitt=e-es, -at their own cost and
expense, and without cost or expense to the
City of Saint Paul, shall convey or cause to be
conveyed unto said City such perpetual public
easement ten feet in width, having acenter line
defined by the Commissioner of Public Works to
accommodate the.construction, maintenance and
operation of said public sanitary sewer under a
deed of easement approved as to form and execu-
tion by the Corporation Counsel, such to be done
within the period of 90 days next after the enact-
ment of this ordinance. '
3. Said permittees shall pay the cost of
engineering and inspection of said work, and
the cost of publication of this ordinance.
4. Said permittees shall properly protect
all excavations made-in the strip of land
embracing said easement, both day and night, so
as to avoid all damage or injury to person or

Thousand Dollars ($5,000.00), conditioned to
comply with all the terms of th t ordinance and
to indemnify and save harmless said City from
all liability, charges, loss, judgtne,nts, suits,
costs or expense that may accrue to persons or
property occasioned by the making of said im-
provement or arising out of the same.
7. Said public sanitary sewer shall serve
the following described property: (1) '.All of
Lot 2, Lake Residences except the east 135 feet
thereof and except the south 178 feet thereof;
(2) the west 200 feet of the east 515 feet of'
the south 150 feet of Lot 3, Lake Residences;
(3) the west 142 feet of the east 405 feet of
Lot 3, Lake,. Residences e�ccept the south 150 feet
and except .the north 80 feet. +,e.,`
8. Said permittee -shall; within ten days
after the passage and publication of this ordinance,
file a ,written acceptance thereof with the City
Clerk.
Section 3. This ordinance is here}y declared to be an

emergency ordinance rendered necessary for the preservation of

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN $
