RESOLVED, that upon appeal of Walter A. Heuer and
Elsie Heuer from the decision,of the Commissioner of Parks,
Playgrounds and Public Buildings, and upon the favorable
recommendation of the Board of Zoning, the commercial use author-
ized on a portion of the following described property, to -wit:
the c -6: s',t 50 feet of Lots 6, 7 and 8, Block 110, West St. Paul
Proper, located on the north side of King Street between Robert
and State Streets, is hereby extended to cover all of said tract,
in connection with the erection of a 7 unit apartment building

Honorable Mayor and Council Members;
We the applicants Walter A. and Elsie Heuer wish to submit to
you this application for your consideration and approval of said
property, which is now vacant.
We have two joining lots on the North side of East King Street
between South Robert and State Street. They are the East 100 ft.
of lots 6,7 &8.
The property is now a sand hill trhich is a eye sore to the City.
We plan to level off this property and build a multiple unit on the
lower lot. The joining lot,we plan to keep as a pa�rk.to beautify
our property, which will stay as B zone which it is now.
The contour of State St.' cuts across:- aboutc40rfeet of our lower
lot which leaves about 10 feet that is not commercial.
Our appeal is to extend the commercial on that portion "to the
commercial use of the entire lot.
Wa propose to use the property to permit off street parking in
connection with a multiple unit.
There is only one house on our side of the strebtin the entire
block and that sets back about 25 ft. from the side walk. It is
about 35 years old. Across the street are two vacant lots, one du-
plex and one fairly new house. We have spoken to the owner in the
new house and he has -no objections to our plans.
We have entered any^ &ppeal to establish a building line of loft.
On East Kimg Street. y
The City Planning Board has pa®" -ge &''"- extention of commercial
on the property but the appeal of the building line has not been
heard as yet.

Dear Sir:
This is in the matter of the appeal of Walter A. and Elsie Heuer'to extend the
-commercial use-permitted'oh"a portion -of a tract to the entire tract for
purpose'"of erecting a•seven -unit apartment building with off - street parking
accessory thereto on property located on the north side of King Street between
Robert and State Streets„ Part of'the property is zoned !xcommercial ", and the
remainder is zoned "B" Residential.' The legal description is: the,�0 feet
of Lots 6, 7, 8, Block 1i0, West St. Paul Proper.
The site•is presently vacant and undeveloped and the applicants'pr6p6se to
develpp it "as stated above. The property has a "frontag6"of•'•50 feet bn' King
Street, extending to a depth of 1.50 feet, resulting'in an area of 7,500 square
feet. A pproximately 50% of the tract is zoned "commercial" by virtue of the
fact that State Street is zoned "commercial" to a depth of 100 feet. The
applicant is appealing to extend this commercial zoning to include the entire
tract.
The adjacent land uses are :• west and adjoining. is -a single- family residence
which fronts on King Street`and is"set back a- distance. of 24,feet fiom'King
Street, east and adjoining is the rear yard of a residence which fronts on
State Street and which is substantially below the grade of the property under
consideration; north and-adjoining is a large multi- family residence which
fronts on Stevens �vefiue, which lot is approximately 12 feet above'the appli-
cant's property; south across King Street are single - family residences which
front on King Street.
Field investigation discloses that the proposed development would not be'
desirable for this size site. The applicant's plat -plan iridicates
_ �that�approx-
imately 70� of the site will be' occupied by^ the `building and parking lot
leaving only 30% for yard space. The plan further indicates that it would -be
necessary for the applicant to also secure a change in the existing building
line to ten feet if the extension of use is permitted.
The Board of Zoning - considered this matter at
and recommend the granting of the extension-of
entire tract for the above described property.
