Mr. Yannarelly stated that the Fire C of O was revoked on what appeared to be May 6, 2009;
however, the property was referred to the Vacant Building Program and the vacant building file was
opened on Match 19, 2009 as a category 1 vacant building. On March 19, 2009, a registration letter
was sent to pay the 2009 vacant building fees and when the owner failed to pay, a warning letter
was sent on Apri120. When the owner failed to comply, the vacant building fee in the amount of
$1,070 went to assessment on June 1, 2009.
Roger Berres, property owner, stated that he believed the hearing was regarding another property he
owned at 702 Preble Street. He said he had spent over $1Q000 in rehabilitation costs and didn't
have any money left to put into his property at 804 Cook. He said he had been working with
Inspector Barb Cummings and had evicted all of the tenants in the building due to overcrowding
back in December 2008. The building had been vacant since; however, he had made most of the
repairs on the deficiency list. He provided a copy of the deficiency list issued by Inspector
Cummings.
Ms. Moermond reviewed the orders issued by Fire which lead to the revocation of the C of O. She
said it appeared that permits had been pulled for the electrical work that had been done which was
finaled. She asked Mr. Berres whether he had provided the approved parking surface in the yard.
Mr. Benes responded that he had not done so yet.
Ms. Moermond stated that in reviewing the orders, she believed the revocation and referral to the
Vacant Building Program was premature. She told Mr. Berres that she would grant him until
December 2009 to provide the parking surface and get the building reoccupied. She suggested he
hire a tenant screening agency to find respectable tenants to live in the building. She recommended
deleting the assessment and if the vacant building file was not closed by December, the department
could reassess the vacant building fee at that time.
233 Iw Avenue West (VB0905)
Referred back by Council on September 16.
Mr. Yannarelly stated that the Fire C of O was revoked on March 5, 2009 and the vacant building
file was opened on March 20, 2009 as a category 1 vacant building. On March 20, 2009, a
registration letter was sent to pay the 2009 vacant building fees and when the owner failed to pay, a
warnuig letter was sent on Apri120. When the owner failed to comply, the vacant building fee in
the amount of $1,070 went to assessment on June 1, 2009. He noted that the C of O revocation
orders issued by Inspector Lisa Martin were attached to the worksheet for review.
Jeff Nolan, property owner, stated that he was in the process of fixing up the house and had put up
new siding, new trim on the windows, and now had the funds to make the repairs. He said he had a
friend who worked at NSP who came and repaired the electrical mast which only required securing

with a bracket. He said when he received the orders, there was nothing indicating his right to
appeal. He did not believe he should have been referred to the Vacant Building Program as he was
not given the opportuniTy or the time to make the repairs to the house. He said he was now in a
fmancial position to complete the repairs and to have the building reoccupied.
Ms. Moermond reviewed the orders and noted that there was nothing on the orders indicating Mr.
Nolan had the right to an appeal. She believed the revocation was untimely and the orders were
flawed since the property was listed with an immediate vacate without a condemnation order in
place. She indicated to Mr. Nolan that she would recommend deleting the assessment and giving
him until January 2010 to complete the repairs and reoccupy the building. If the building was not
brought into compliance by that time and the property reoccupied, the department could reassess the
vacant building fee at that time.
