The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WfIEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 7, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 533 MINNEHAHA AVENUE EAST. i. 2. 3. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollazs ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. Ga � That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subj ect to demolition. That this building has been routinely monitored by Deparhnent of Safety and Inspections, VacanUNuisance Buildings. That the lrnown interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. •'� • l. The rehabilitation or demolition and removal of the structure must be completed within fifteen (1� days after the date of the Council Hearing. 2. If the above correcUve action is not completed within this period of time Department of Sa£ety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this strucriu fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 107 4. According to our files, it has been a vacant building since July 20, 2008. The current property owner is Antwaign M Murphy, per AMANDA and Ramsey County property records. The city has had to board this building to secure it from trespass. There have been three (3) SUMMARY ABATEMENT NOTICES since 2009. There have been three (3) WORK ORDERS issued for: - Boarding/securing - Removal of tall grass and weeds - Improperly stored refuse, garbage and misc debris On May 6, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on June 8, 2009 with a compiiance date of July 8, 2009. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (2009-2010 due-assessed on 7/20/09, '08-'09 also went into assessment) Taxation has placed an estimated market value of �11,900 on the land and $70,000 on the building. Repair all holes, breaks, loose or rotting siding, to a professional state of maintenance. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken window glass. Make all necessary repairs to frames, sashes, hardwaze and associated trim in a professional manner. Permit may be required. 4. The window and/ar door screens are missing, defective or in a state of disrepair. Provide proper window and door screens for all openable windows and doors. Screens must be tight-fitting and securely fastened to the frames. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a professianal manner to a weather-tight, watex-tight and rodent-proof condition. Permit may be required. 6. The eaves and soffits are in a state of disrepair or deter3oration. Repair all defects, holes, breaks, loose or rotting boazds, to a professional state of maintenance. Permit may be required. 7. Front steps are in disrepair. 8. The stairs have missing or defective handrails. Provide a11 interior and exterior stairways and steps of more than thzee (3) risers with handrails which are grippable and installed 34" — 38" above the nose of the stair treads. 9. Interior full of garbage/rubbish/debris. Remove all garbage/rubbish/debris. 10. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and make any necessary repairs. Perform a CJO test on the heating plant. Then, send the attached form back to the Inspector. Repair of gas fired appliances requires a perxnit. 11. Lack of Blectricity. 09-1115 As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by July 8, 2009 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. The property shall not be sold, transferred or conveyed in any manner until the Nuisance Conditions have been abated and the Certificate of Code Compliance or Certificate of Occupancy has been issued. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The departznent is further required to file a copy of this "Order to Abate" with the Citp C1erk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time Yestimony will be heard from interested parties. After thzs hearing the C3ty Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. Ordering the owner to remove or repair the building(s) at 533 Minnehaha Avenue East within fifteen (15) days from adoption of resolution. Jerry Filla, attorney with Peterson, Fram & Ber�nan, appeared on behalf of the property owner, US Bank Home Mortgage. No other parties of interest appeared. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two- story, wood frame, single-family dwelling on a lot of 2,614 square feet and had been vacant since July 20, 2008. A code compliance inspecrion had not been done, the vacant building registration fees in the amount of $1,000 went to assessment on July 20, 2009, and the $5,000 performance bond had not been posted. On May 6, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 8, 2009 with a compliance date of July 8, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $11,900 and the building to be $70,000. Real estate taxes current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $10,000 to $12,000. There had also been three summary abatements issued to this property since 2008, three of which went to wark order: to secure the building and the City had to boazd the building to secure it from trespass, remove improperly stored refuse and debris, boarding/securing, and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1884 as a worker's cottage-style building with Italianate proportions. Originally, there were two houses on this one lot with a single apartment building in the reaz of the property. She noted that the siding had been covered and much of the integrity had been lost. The property had not been surveyed and was not located in any potential historic district. She did not believe demolition would have an adverse effect to the neighborhood. Mr. Filla stated that the redemption period had expired on August 19, 2009 and Hal Rossie, with US Bank, had looked at the building and believed it could be rehabbed. He requested additional time in order for his client to put together plans to rehabilitate the building. Ms. Moermond stated that the following conditions must be met by September 30 in order to consider a grant of time: 1) the $5,000 performance deposit must be posted; 2) a code compliance inspection must be obtained; 3) provide contractor bids, which could include swom construction statements; 4) provide an affidavit committing the funds for this project; 5) provide a work plan including timelines to complete the rehabilitation; and 6) the property must be maintained.
