WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated June 8, 2009; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by July 8, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, September 8, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the 09-1114 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 Interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and W�IEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 7, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLUED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order conceming the Subject Property at 857 LAWSON AVENUE EAST. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollazs ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subj ect Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subj ect to demolition. 7. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the lrnown interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its 09-1114 85 86 87 88 89 2. 90 91 92 93 94 95 96 97 98 99 100 101 102 blighting influence on the by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition and removal of the structure must be completed within fdteen (15) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps aze necessary to demolish and remove this shuchue, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since October 10, 2007. The cunent property owner is Highland Bank per AMANDA and Ramsey County property records. The city has had to board this building to secure it from trespass. There have been nine (9) SUMMARY ABATEMENT NOTICES since 2007. There have been ten (10) WORK ORDERS issued for: - Boazding/securing - Removal of tall grass and weeds - Improperly stored refuse, garbage and misc debris - Removal of snow and ice On April 14, 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NTJISANCE BUILDING was posted on June 8, 2009 with a compliance date of July 8, 2009. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Where wall and ceiling covering is removed, attic, replace doors and windows, (insulation, glass, weather stripping, etc.) shall meet new energy code standards. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead base paint is present). Provide general clean-up of premise. Provide smoke detectors as per the Minnesota State Building Code. Repair soffit, fascia trim, etc. as necessary. Provide proper drainage around house to direct water away from foundation. Rebuild front retaining wall. Replace basement stairs and install guardrail and handrail to code. Remove suspended ceilings on first floor and insure ceiling above is one hour fire rated. Insure 6" clearance from siding to grade on front porch. Install landings at west and north entrys. ELECTRICAL 1. Ground the electrical service to the water service within 5'of the entrance point of the water service. 2. Provide adequate clearance from flue vent pipe on furnace/boiler to combustible materials or provide approved shielding according to Code. 7. Provide adequate combustion air. 8. ZONING This house was inspected as a duplex. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not carrected by July 08, 2009 the Department of Safety and Inspections, Division of Code Enforcement, will begin a subsYantial abatement process to demolish and remove the building(s). The costs of this action, including adminish costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with 1aw. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. HPC staff also ean be reached by cailing 651-266-9078. �une 8, 2009 857 LAWSON AVE E page 5 09-1114 As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. The property shall not be sold, transferred or conveyed in any manner until the Nuisance Conditions have been abated and the Certificate of Code Compliance or Certificate of Occupancy has been issued. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the �nitten authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify Che City Council that abatement action is necessary. The City Clerk wi11 then schedule dates for Public Heazings before the City Council at which time testimony will be heard from interested parties. After this heazing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Council may either oxder the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. The costs of this action, including administrative costs will be assessed against tbe property as a special assessment in accordance with law. Ordering the owner to remove or repair the building(s) at 857 Lawson Avenue East within fifteen (15) days from adoption ofresolution. The property owner of record, Hi�hland Bank, did not appear. No other parties of interest appeared. Mr. Magner stated the building was a one and one-half story, wood frame, duplex on a lot of 4,792 square feet and had been vacant since September 30, 2008. A code compliance inspection had been done on January 1, 2008 which had since expired, the vacant building registration fees in the amount of $1,000 went to assessment on December 19, 2008, and the $5,000 performance bond had not been posted. On June 4, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 10, 2009 with a compliance date of July 10, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land to be approximately $36,000 and the building to be $125,800. Real estate taaces were. Code Enfarcement estimates the cost to repair the building to be approximately $40,000 to $50,000. The cost for demolition was estimated to be approximately $10,000 to $12,000. There had also been two summary abatements issued to this property since 2008, seven of which went to work order: to secure the building and the City had to boazd the building to secure it from trespass, remove improperly stored refuse and debris, boarding/securing, and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that she could not find an original building permit and believed the building was built pre-1885. The block face was intact but was not located in any potential historic district and the property had not been surveyed. Although she believed the building had good integrity, she did not believe demolition would have an adverse effect on the neighborhood. Ms. Moermond noted that the ownership history for this property was similar to that of 127 Cayuga Street with Highland Bank and Danna Investors having an interest. Since no one appeared, she recommended the building be removed within 15 days with no option for repair. '
