This property is legally described as follows, to wit: OAK VILLE PARK LOT 14 BLK 16 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before June 2, 2009, the following are the now known interested or responsible parties far the Subject Property: Peter J Bazil, 3535 Ivy Place, Wayzata, MN 55391-9746; IndyMac Bank, FSB, I55 North Lake Avenue, Pasadena, CA 9ll O1; Bazil & Bazil PLLC; 574 Prairie Center Drive, #135114, Eden Prairie, MN 55344; Barbara Christy, JP Morgan, 800 State Hwy 121 Bypass, Louisville, TX 75067-4180; Atlas EMC c/o Lentz Team Associates, 3464 Washington Drive #100, Eagan, MN 55122; Payne Phalen District 5 Planning Council. WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated June 2, 2009; and WHEREAS, this order informed the then lrnown interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by July 2, 2009; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, September 8, 2009 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the 09-1111 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 7, 2009 and the testimony and evidence including the action taken by the Legislatfve Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 717 GERANIUM AVENUE EAST. 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � � That the deficiencies causing this nuisance conditaon have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Deparhnent of Safety and Inspections, Vacant/Nuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. �•� � The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its 1. 09-1111 88 89 90 91 92 93 94 95 2. 96 97 98 99 100 101 3. 102 103 104 105 106 107 4. 108 blighting influence on the community by rehabilitating this structure and correcring all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition and removal of the structure must be completed within t`ifteen (15) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Tnspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since May 16, 2008. The current property owner is Peter Bazil, per AMANDA and Ramsey County property records. (Note.• Per Peter Bazil's letter dated 8-26-09, EMC Mortgage Corp is now the owner. SM rec'd a call from Nancy Lane (214-626-3365), of EMC Mortgage, stating that they did received the Notice of Public Hearing and it was sent to their Escalation Division and they requested she contact our offzce. This paYticularproperty is on their inventory as unavailablepropeYty at thispoint because the redemption period does not expire until December 2009 and any issues with the property, EMC Mortgage does not have the authority to deal with until the completion of the redemption period). The city has had to boazd this building to secure it from trespass. There have been nine (9) SUMMARY ABATEMENT NOTICES since 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (2009-2010 assess — due 7-17-09) TaYation has placed an estimated market value of $19,400 on the land and $170,700 on the building. As of August 31, 2009, a Code Compliance Inspection has not been completed. (Note: existing CCI expired June 9, 2009) As of August 31, 2009, the $5,000.00 performance bond has not been posted. Details of this report are as follows: BUILDING 1. Repair damaged siding as necessary. 2. Install rain leaders to direct drainage away from foundation. 3. Dry out basement. Remove mold and mildew. Mitigate moisture source. 4. Remove char from fire-damaged floor joists over basement. Install an addition joist along side of each fire-damaged joist in approved manner. 5. Repair gazage soffit, fascia, siding, sheathing and trim as necessary. 6. Weather-seal and vermin-seal garage overhead door. 7. Provide minimum 6" clearance beriveen wood and soil at garage. 8. Repair or replace garage service door. 9. Replace gutters and downspouts at garage. 10. Insure basement cellaz floor is even, is cleanable, and all holes are filled. 11. Install tempered glass in window on basement stair. 12. Repair walls and ceilings throughout, as necessary. 13. Provide hand and guardrails on all stairways and steps, as per attachment. 14. Prepare and paint interiar and exterior as necessary (take the necessary precautions lf lead base paint is present). 15. Provide general clean-up of premise. 16. Provide smoke detectors as per the Minnesota State Building Code. 17. Provide proper drainage around house to direct water away from foundation. ELECTRICAL 1. Ground the electrical service to the water service within 5' of the entrance point of the water service. 2. Bond around water meter with a copper wire sized far the electrical service per Article 250 of the NEC. 3. Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers and plates. 4. Check a113-wire outlets for proper polarity and verify ground. 5. Install hard-wired, battery backup and smoke detectars as specified in Bulletin 80-1 and other smoke detectors as required by the IRC. 6. Any open walls or walls that aze opened as part of this project must be wired to the standazds of the 2005 NEC. PLUMBING All plumbing work requires permit(s) and must be done by a plumbing contractor licensed in Saint Paul. Basement: l. Water heater temperahzre and pressure relief valve discharge piping is incorrect. 2. Water heater no gas or gas piping is incorrect. 3. Water piping is inconect. 4. Heater is not fired or in service. 5. Water meter is removed; not in service. 6. Remove meter from pit. 7. Repair or replace all conoded, broken or leaking water piping. 8. Improper water piping or usage. 9. Boiler fill water line requires backflow assembly or device. 10. Provide water piping to all fixtures & appliance. 11. Replace conoded gas piping. 12. Soil and waste piping has no front sewer cleanout; no soil stack base cleanout. 13. Lavatory tub fixture is broken or has missing parts. 14. Faucet is missing, broken or missing parts. 2 Floor: 1. Reset water closet fixture to code. HEATING 1. Repair or replace hand valve on heating system radiators. 2. Clean and Orsat furnace/wall burner. Check all controls for proper operation. Check furnace heat exchanger for leaks and provide documentation from a licensed contractor that the heating unit is safe. 3. Vent clothes dryer to code. (Ventilation permit and inspection is required). 4. Provide adequate combustion air and support to code. 5. Provide support for gas lines to Code. Plug, cap and/or remove all disconnected gas lines. 6. Support supply and retum piping for heating system according to Code. 7. Provide back flow preventer on city water fill line to hot water/steam heating system. 8. Appropriate Mechanical Permits are required far this work. ZONING This structure was inspected as a Single Family Residence. June 2, 2009 717 GERANNM AVE E page 4 o9-iiii As owner, agent or responsible party, you are hereby norified that if these deficiencies and the resulting nuisance condition is not corrected by 3uly 2, 2009 The Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, includin; administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. If this building is located in a historic district or site (noted above, just below the property address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by this order and compliance with preservation guidelines. Copies of the guidelines and design review application and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC staff also can be reached by calling 651-266-9078. As an owner or responsible party, you are required by law to provide full and complete disclosure oFthis "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. The property shall not be sold, transferred or conveyed in any manner until the Nuisance Conditions have been abated and the Certificate of Code Compliance or Certificate of Occupancy has been issued. The Enforcement Officer is required by law to post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order to Abate" with the City Clerk's Office. If corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Council that abatement action is necessazy. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Counci] may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. The costs of this action, including administrative costs will be assessed against the property as a special assessment in accordance with law. Laurie Macko, realtor with Keller Williams, also appeared on behalf of EMC Mortgage. Daniel Schmidt, 714 Geranium Avenue East, a neighbor, appeazed. Ms. Moermond asked Mr. Magner for a report. Mr. Magner stated the building was a two-story, wood frame, single-family dwelling with a detached one-stall garage on a lot of 4,792 square feet and had been vacant since May 16, 2008. A code compliance inspection had been done on June 9, 2008 which had since expired, the vacant building registration fees in the amount of $1,000 went to assessment on July 17, 2009, and the $5,000 performance bond had not been posted. On Apri123, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 2, 2009 with a compliance date of July 2, 2009. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County TaYation estimated the market value of the land to be approximately $19,400 and the building to be $170,700. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $40,000 to $50,000. The cost for demolition was estimated to be approximately $8,000 to $10,000. There had also been nine summary abatements issued to this property since 2008, five of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and debris, boarding(securing, and cut ta11 grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1887 and was a Queen Anne-style building. She said there was a loss of integrity with the windows being altered, the porch had been removed, and there had been some additions added early on. It had not been surveyed and did not have any potential as a historic resource to the neighborhood; however, she encouraged rehab as it was a substantial-sized house. Mr. Schmidt presented a letter from the Payne Phalen District 5 Planning Council which he read into the record. A copy of said letter is attached and made a part of these minutes. Mr. Schmidt stated that he was not at the hearing to represent the District 5 Planning Council but was there on behalf of the neighborhood. He said he had bought his property at 714 Geranium in 2003 and also recently bought the vacant property at 718 Geranium. The property at 717 had been a problem in the neighborhood for many years. He said he had been through the building which had six to eight bedrooms and given the significant alterations to the interior, he believed it completely lacked any architectural integrity. In May 2008, there had been at least 13 people living in the house with animals and he considered it to be a"hoarder" house as he had witnessed the house being cleaned out by people in Hazmat suits after the people left. He said that in October 2008, squatters took over and were coming and going all day and night, were living in the garage, and hanging out in the front yard. He said he had worked with Historic St. Paul in restoring the original character of his house and did not believe 717 could be rehabilitated to its historic nahxre without a lazge financial inveshnent. He also believed it would continue to be a nuisance given the over-occupancy of the property. He requested the property be demolished. 09-1111 September 8, 2009 Legislative Hearing Minutes Page 7 Ms. Moermond asked Mr. Magner if there was any record of squattezs at the property. Mr. Magner responded that according to the file, there were on-going issues with people coming and going at the property all day and night in September through October 2008 and the police had made some arrests. Ms. Macko stated that the redemption period did not expire unril December 2009 and at this point, EMC Mortgage was not in a position to be able to do anything with the property. Ms. Moermond asked whether there was any attempt to shorten the redemption period. Ms. Macko responded that by the time of the sheriff sale and filing the court documents, it would be November before they would have a court date and EMC did not believe it was beneficial to shorten the redemption period. She said she had gone through the property on June 16 and said she did not believe the house was in bad shape. She presented photos of the property. She said she had applied for a new code compliance inspection in June 2009; however, when EMC put the status of the property on hold, they decided to hold off on the inspection and requested a refund of their money. She said she did not have a copy of the code compliance inspection report from 2008 and was unawaze of what was on the list. She said at this point in time, EMC was requesting an extension of time to be able to get the code compliance inspection done, to obtain bids to do the rehabilitation as well as to do the demolition. EMC, however, was not in a position at this time to make a decision conceming the property since they did not have clear legal title to the property. Mr. Magner suggested to Ms. Macko that the contractors use the code compliance inspection from 2008 to present bids and once they had the report from 2009, they could amend the bids to include any additional items found on the new report. Ms. Moermond stated that in order to receive a grant of time, the following conditions must be met: 1) the $5,000 performance deposit must be posted by September 25; 2) a new code compliance inspection must be obtained; 3) obtain contractor bids based on the expired code compliance which can be amended once the new report is obtained; and 4) the property must be maintained. At the Council Public Hearing on October 7, she will recommend continuing the Legislative Hearing to October 27 and Council Public Hearing to November 18. This would allow time for the mortgage company to determine what they wanted to do with the property. o9-iiii September 8, 2009 Re: Hearing Matter on the disposition of 717 Geranium The Payne Phalen District Five Planning Council strongly supports the removal of 717 Geranium. This property has long been a nuisance to residents on the block. A history of neglect and poor management has created dilapidated conditions in the structare that cannot be easily remedied. Invest Saint Paul volunteers canvassed the area homes and determined that 717 Geranium neither substantially nor positively contributes to the existing character of the neighborhood. The properiy structure does hold promise for sufficient rehab and redevelopment. The Council position is that demolition of 717 geranium is an improvement to this block.
