The legal description is: that part of Lot 12, Lake Como Villas, lying northerly of the rigbt -of -way of the Northern Pacific.Railroad except the southerly 25 feet thereof. The pro-<" perty is zoned "'A"' Residence, and has been since 1922. _ On March 5, 1959, the Commissioner of Finance reported the petition sufficient with 90%, or the owners of 27 of the 30 parcels of land lying within a 100 foot radius of the property having'signed the petition. The Board of Education are the-owners of a considerable portion of the adjoining property and have signed the petition only so that it may be heard by the council. 'Please note the memo �l attached to the accompanying petition. At present the tract under consideration is the site of the Grant Construction Company office building and storage yard. If the petition to rezone is granted, the applicant proposes to develop the site with three two and one -ball story eleven unit, brick and stucco apartment buildings and off-street parking access- ory thereto. The plot plan of the applicant indicates.tbat the existing office building will remain, and that the proposed apartment development will include approximately 60 feet of width of the tract adjoining on the west, which would be used for part of the off-street parking. This property is presently zoned II All Residence. The applicant has further indicated that he would petition to re- classify the tracts to'the west and adjoining the property under consideration. This property fronts on Geranium Avenue. The site has a frontage of 203.9 feet along unimproved Geranium Avenue, ands 267.39 feet along unimproved North Avon Street. This site is in the shape of a trapezoid and has an area of approximately 59,213 square feet, or 1.38 acres. The adjacent land uses are: north and east across unimproved streets Is the Como Park Junior High School grounds; south and-adjoining is the Northern Pacific railroad railway; farther douth across the railroad tracks is vacant land, and south of the vacant landiare single family residences fronting on Como Avenue and Grotto Avenue; southwest across Como Avenue, a neighborhood grocery and food freezer sales store with residential use over, also two single family resi- dences; west and across alley are - single family residences fronting on Como Avenue. The applicant's proposal will meet the recommended density and building coverage standard. A review of the matter by the Board of Zoning and it's staff, and field investigation discloses that the entire area is predominantly single family residence in character. The site, itself, is level and the alley is ungraded. Fred Murnane - Page 2 In the opinion of the Board of Zoning, it appears reasonable to grade the streets adjoining this property so the property can be developed as a site for single family dwellings. The Board of Zoning has made the following additional findings: The request to rezone this property to "C" Resodence is unreasonable because the surrounding area is developed with single family residences; the denial of this petition will not create a hardship on the petitioner as'it appears feasible to develop this site in a manner similar to the surrounding area; the rezoning of this property would be "spot zoning ", and it would be detrimental to the adjoin- ing properties.
