This is in'the matter of, C. _,G. Rein's "petition for an amendment to the Zoning Code to rezone from "Alt to "C" residence certain pro- perty located on the south side of Case Avenue between White Bear and Flandreau.' The property is described as Lots 4 through 15 inclusive, Block 1, Birminham Park. The zoning is "A" residence. The Com_missioner'of Finance reports that the petition is sufficient and that the owners of 22 of the 30 parcels of land within the 100' radius have signed the petition. This amounts to 737o. The property was purchased by thd� petitioner from the Land Commissioner's office at -a tax - forfeit land sale, on July_ 15, 1956. Prior to the time of the sale of this property, it was being held for possible future expansion .of the Ames School site. At present the property is vacant and iin- developed. If the re'- zoning is granted, the applicant proposes to develop the site with four 12 -unit apartment buildings and off - street parking facilities accessory thereto. This site has a frontage of 480' along Case Avenue and a depth of 100' resulting in an area of 48, 000 square feet. One side of the site fronts on Flandreau Street. The adjacent land uses are as follows: north across Case Avenue is the Ames School; east and adjoining is a single- family residence which fronts on Case; east of that is a small restaurant with an apartment over it which fronts on White Bear Avenue; west across Flandreau are single- family residences fronting on Flandreau; south across the alley is a single - family residence fronting on Flandreau; also across the alley are vacant lots which are being developed with three 12 -unit apartment buildings which will front on Sims Avenue. On January 31, 1959, the City Council re- classified the property directly south and across the alley to "C" residence. This property, which was reclassified, fronts on Sims Street. A review of the applicant's plans reveals that the proposed development will meet the recommended build- ing coverage and density standards. 3- C. G.
