Resolved, That it appearing from the
!port of the Land Committee in the
emises, that the following described
erpetual.,easement in, upon over and
RESOLVED, that it appearing from the report of the _Land
Committee in the premises, that the following described perpetual
easement in, upon, over and through the lands of the Chicago,
Milwaukee, St.Paul and Pacific Railroad Company, necessary for
the pending opening, widening and extending of Return Court from
the south line of Biaanz Highland- Plains No. 2 to Prior Avenue,
is proposed to be granted and conveyed, at private sale, under
that certain proposed indenture dated the 4th day of February
1959, by and between said Company therein designated as grantor
and said City therein designated as grantee, such easement being
therein described as follows:
"A paramount perpetual easement forty (40) feet
in width, for all the usual purposes of a public
street, across the right -of -way of the Grantor
in the North Half of the Northwest Quarter (N/'2
NW %) of Section Twenty -one (21), Townshi Twenty -
eight (28) North, Range Twenty -three (23� West,
in the City of Saint Paul, County of Ramsey and
State of Minnesota, the center line of which
easement i`s_J described as follows:
"Beginning at a point that lies thirty -four and -
farteen hundredths (34.14) feet easterly of the
southeast corner of Lot Sixteen (16), Block Nine
(9), B isanz Highland Plains No. 2 and on the
south line of said addition; thence in a south-
easterly direction to a point twenty -four and
twenty -five hundredths (24.25) feet north of the
southerly line of the Grantort's right -of -way and
on the center line of Prior Avenue produced
northerly; thence south along the extended center
line of Prior Avenue produced to the southerly
line of said Grantorts right -of -way;
"The westerly line of said easement being a line
described "as follows:

"Beginning at the southeast corner of Lot Sixteen
(16), Block Nine (9), Bisanz Highland Plains No. 2;
thence in a southeasterly direction parallel to
the center line of" said easement and distant twenty
(20) feet therefrom to its intersection with the
extended west line of Prior Avenue; thence south
along the extended west line of Prior Avenue to
the southerly line of said Grantor's right -of -way;
'The easterly line of said easement being a line
described as follows:
"Beginning at a point on said Grantor's northerly
right -of -way line and sixty -eight and twenty -eight
hundredths (68.28) feet easterly of the southeast
corner-of Lot Sixteen (16), Block Nine (9), Bisanz
Highlarid-Plains No. 2; thence in a southeasterly
direction parallel'to -the center line of said ease-
ment and distant twenty (20) feet therefrom to its
intersection with the extended east line of Prior
Avenue; thence south along the,extended east line
of Prior Avenue to the southerly line of said
Grantor's right -of -way;

'Reserving, however, unto said Grantor the right
to continue the use and operation of all existing
railroad facilities, and the right for itself,
its "successors and assigns, to construct, maintain
and operate such additional railroad facilities
at said place as it may desire, in addition to
those now existing, provided, however, that the
same shall not_ interfere with the purpose of

-easement by said City thereunder is advisable and in its best
interest, and that the same should be hereby authorized, the
proper City officers be and hereby are authorized and directed
in behalf of said City, to execute said proposed indenture for
said purpose'and to perform all acts and things necessary in
the premises to the acquisition by said City of said easement
at such sale and for said reasonable price; be it -
FURTHER RESOLVED, that said price to become and be payable
under said proposed indenture by said City as and for the consid-
eration for said grant of said easement, unto_ said company, shall
be paid from the City's P. I. R. Fund 3001 and to be reimbursed
from Local Improvement Aid - City's SHaie - Fund 31 E 1.
FURTHER RESOLVED, that in accordance with additional provi-
sions of said Grant`i,.the - above described parcel of land under said
paramount perpetual-'e:asement shall be used by the Grantee only for
the aforesaid public puiposes and neither'said Grantor nor its
property shall be subject in any way to any cost, expense or
assessment for the initial grading; surfacing or drainage of the
public roadway proposed to be constructed within said paramount
perpetual easement by said Grantee, save that said Grantor shall
construct and maintain the necessary plank crossing over its exist -
inghrailroad tracks and over any railroad tracks hereafter constructed
and maintained by -it within the lines of said paramount perpetual
easement, at said GrantorYS own separate cost and expense.

The undersigned Committee on Lands, in the prem-
ises, pursuant to Section 303 of the Charter of the City
of Saint Paul, upon due investigation in the premises hereby-
reports its recommendation that the required paramount per-
petual easement for the pending opening, widening and extend-
ing of Return Court from the South Line of Bisanz Highland
Plains No. 2 to Prior Avenue, in the City of Saint Paul,
more particularly described in Exhibit "A" hereto attached,
(proposed form of Council Resolution) be purchased by the
City of Saint Paul, at private sale, from Chicago, Milwaukee,
St. Paul and Pacific Railroad Company, the owner of the
subject land, as now proposed and offered by said Company
to the City for the reasonable price of $500.00, and that
your Honorable Body authorize such purchase and provide for
the payment of such purchase price from the City's P. I. R.
Fund 3001, subject to its reimbursement from Local Improve-
ment - City's Share - Fund 31 E 1.
