whereas, The Zoo Committee has
recommended that a chain wire fence
be erected around the area occupied
by the Zoo at Como Park, and said

WHEREAS, the Zoo Committee has recommended that a chain
wire fence be erected around the area occupied by the Zoo at Como
Park, and said work will be done this spring, and
WHEREAS, the Department of Parks, Playgrounds and Public
Buildings feels that it is desirable to have a refreshment, refectory
in the area, outside of the fenced -in zoo area occupied by the
amusement rides, and
WHEREAS, said refectory building will cost in the neigh-
borhood of $10,000, and the Department of Parks, Playgroundsand
Public Buildings is without funds to build such a facility, and
WHEREAS, Mr. Fred C. O'Neil, doing business as O'Neil
.Amusements,-the operator of the rides in the aforementioned area,
has offered to build such a refectory building and donate it to
the Department of Parks, Playgrounds-add Public Buildings, and
WHEREAS, said Fred C. O'Neil desires to lease said building
for a period of five years, in return forwhich he will pay a rental
of 25 per cent of the gross income from said refectory, and
WHEREAS, a meeting was held to discuss this offer, between
Joseph J. Mitchell, City Comptroller, Ray Schneider of the Zoo
Committee, W. L. Kaufman, Superintendent of Parks, Commissioner
B. T. Holland, and Fred C. O'Neil, whereat it was determined unanimously
that it would be desirable to place the operation of the other 3
refectories at the Zoo area, one being in the picnic grounds and two
being in the Zoo area, one called the Upper Refectory and one called
Lower Refectory, under the uniform management of one operator at the
aforementioned rental of 25 per cent of the gross income from said
operations, therefore be it
RESOLVED, that the Council hereby concurs in the recommen-
dations of the Commissioner of Parks, Playgrounds and Public Buildings
to accept the offer of Fred C. O'Neil, doing business as O'Neil
Amusements, to construct a refectory building in the area of the

amusement rides at the Zoo area in Como Park and also to lease
to said Fred C. 0�Reil the new refectory building and the three
aforementioned refectory buildings for operation for a period
of five years commencing with the 1959 season, at a rental of
25 per cent of gross income from said refectories, the operator
ofsaid concessions to provide a public liability and property
damage insurance policy in an amount not less than $5,000 for
one accident, or a bond in the amount of $5,000, running to the
City of Saint Paul, which policy or bond shall be approved by the
Corporation Counsel, and be it
FURTHER RESOLVED, that the Corporation Counsel be and
he hereby is authorized and directed to draw a lease therefor
which the proper City officers are hereby authorized and directed
to executb in behalf of the City and the Department of Parks
Playgrounds and Public Buildings.
