Dear Sir: JOSEPH R. OKONESKI, City Clerk. (July 11, 1959) This is in the matter-of't a app ca ion of`-A. W. Mailand for a permit to in- stall and operate a ten car private parking lot on property located on the north side of Adrian Street between Hathaway Street and Vista Avenue in conjunction with a proposed 10 'unit apartment building. The applicant is also appealing to relax the 8 foot setback for parking lots which adjoin residential property to four feet. The legal description is: Lots 16 and 17, Block 1, J. N. Rogers Second Addition, and Lots 6 and 7, Sheldon's Rearrangement. The Boning is commercial and has been since the adoption of the Zoning Ordinance in 1922. On December 11, 1958, a nine -car off - street parking lot in conjunction withla proposed 9 unit apartment building was approved by the Planning Director and the Traffic Engineer. This apartment building and parking lot was not developed, and the applicant now proposes to erect a ten -unit apartment building on the site with off- street parking accessory thereto. However, in order to best util- ize the space and provide adequate yard space for the tenants, it is necessary that he appeal to relax the 8 foot side -yard setback which is required under Chapter 60.23, Par. 5 of the Legislative Zoning Code for lots having a capacity of ten or more cars. Field investigation discloses that the parking lot screening can be adequately handled within a four foot buffer which is what the applicant is requesting. , I The property under consideration is irregularly shaped and has a frontage of 120.91 feet along Adrian Street and a depth of 120 feet, resulting in an area of approximately 11,085 square feet. East and adjoining is a two - family residence which fronts on Adrian Street; west and adjoining is the rear yard of a residence which fronts on West Seventh Street; south across Adrian Street is vacant land, farther south is the Socony Vacuum OilTank Farm; north and adjoining are the rear yards of resi- dences which front on West Seventh Street. The Traffic Engineer has approved the plan which meets the standards for this type of development with the exception of the four -foot sideyard setback. ;The proposed development meets the recommended standards for density and building ground coverage. I In consideration of the above factors, the Board of Zoning recommends the grant- ing of this appeal to establish a four -foot side yard setback on the north Iside of Lots 6 and 7, and the west side of Lot 6, Sheldon's Rearrangement; and the granting of a permit for a ten car private parking lot on Lot 15, and 17,lBlock 1, J.
