to the recorded plat thereof, Ramsey County, Minnesota, lying within Lot 5, Block 1, of said plat, and
lying northeasterly of a line described as follows:
Beginning at a point on the north line of said Lot 5, distant 92. 00 feet westerly from the northeast
corner thereof,• thence southeasterly to a point on the east lfne of said Lot 5, distant 90.00 feet
southerly frorre said northeast corner, and said lifae there terminating; and
WIIEREAS, the Department of Public Works and the following utility companies have determined that
no facilities exist within the easement areas proposed to be released; now, therefore be it
RESOLVED, that with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of the Deparhnent of Public Works for the City of Saint Paul; Saint Paul Regional Water
Services, a municipal corporation; Comcast, a Pennsylvania corporation; Qwest, a Colorado corporation; MCI
Network Services, Inc. (Verizon); Northern States Power Company, dba Xcel Energy - Electric, a public utility;
Northern States Power Company, dba Xcel Energy - Gas, a public utiliry; and Dish Energy St. Paul, Inc., a
private, non-profit Minnesota corporation; made a part hereof by this reference and filed an the office of the
City Clerk of Saint Paul, the City, for itself and on behalf of said department and utility companies, waives all
rights to the utility easements as heretofore described; and be it further
RESOLVED, that upon passage of this resolution the proper city officials are hereby authotized and
directed to record a copy of same in the office of the Ramsey County Recorder, and that the City Clerk shall
maintain on file a copy of the CeRificates of Intended Non-Use.
