WHEREAS, William J. Schmidt, an employe of the Department
of Public Safety of the City of Saint Paul, was injured on
February 27, 1959, in a third party accident, while engaged
in the performance of his duties for the Department of Public
Safety, and was disabled for work for a period of time, for
which the City paid him salary in the amount of $980.63; and
WHEREAS, a settlement has been negotiated by the
parties in the total amount of $5,500.00, and the office of
the Corporation Counsel is in possession of draft No. Q 37242
of the Royal -Globe Insurance Group in that amount, payable to
William Schmidt and Samuel Goldberg, his attorney, and City of
Saint Paul, on behalf of their assured, Buerkle Buick, Inc.,
third party involved in said accident, for.-property damage and
bodily injury and the subrogation rights of the City of Saint
Paul; and
WHEREAS, the medical bill of Dr. John Holt for services
to the employe by reason of said accident, in the amount of $539,
will be paid by the employee, and the City has no claim for
property damage because of said accident; and of the amount to
which the City is subrogated, $980.63, Samuel Goldberg is
entitled to 25 per cent for attorney's fees, or $245.16,
leaving $735.47 to be paid to the City toward its expense
for salary paid the employe, now, therefore, be it
RESOLVED, The proper City officers are hereby authorized
to accept said amount of $735.47, in full settlement of its claim
for loss in connection with said third party accident, to be
credited to the proper fund, and further to execute any necessary
releases.
