RESOLVED, that 'Standard Oil Company be permitted to
enlarge and reconstruct an existing filling station at the
southeast corner of Cretin and Marshall Avenues, also described
as Lot 13 and the North 120 feet of Lots 14 and 15, Block 50,
Desnoyer Park, in accordance with plans approved June 4, 1959,
and subject to the condition that Standard Oil Company construct
a so- called privacy fence between the station and the adjoining

Dear Sir:
This is in the matter of "the application of the Standard Oil Company for a
permit to enlarge and reconstruct an existing filling station on property
located on the southeast corner of Cretin and Marshall Avenues. The legal
description is: Lot 13, and the north 120 feet of Lots 14, 15, Block 50,
Desnoyer Park. The,zoning of Lots 14, 15 and the westerly 30.54 feet of
Lot 13, is "Commercial"; the easterly 9.46 feet of Lot 13 is zoned "Cn
Residence and has been since the adoption of the Ordinance in 1922. Under
a separate communication, there is an appeal to extend the commercial use
to this entire Lot 13.
The site is presently occupied by a filling station and a single - family
residence which was built in 1906. The existing filling station was con-
structed in 1934. However, the property has been utilized for filling
station purposes since 1927. The applicant proposes to remove the existing
residence, and completely reconstruct the filling station. IL
The site is irregular in shape with a frontage of 109.46 feet along Marshall
Avenue, and 120 feet along Cretin Avenue, with a depth of 172.9 feet along
the east side of the tract producing an area of approximately 15,255 square
feet. The adjacent land uses are: north across Marshall Avenue are sub-
stantial single- family residences fronting on Marshall Avenue; south and
adjoining is a small grocery store fronting on Cretin Avenue, south across
an alley is a single - family residence fronting on Cretin Avenue; east and
adjoining are single - family residences fronting on Marshall Avenue; west
across Cretin Avenue is a drug store which fronts on Marshall Avenue.
The Traffic Engineer has approved the plans which meet standards for this
type of operation. Field investigation discloses no basic objection as the
reconstruction and enlargement of the existing filling station would be an
improvement over the present operation. In accordance with filling station
standards, the easterly 10 feet of this property would be screen planted
and would serve as a buffer between the station and the adjoining residence
to the east.
In consideration of the above factors, the Board of Zoning recommends the
granting of this application for a permit to enlarge and reconstruct a
filling station on the above described property in accordance with plans
approved June 4, 1959. This, of course, would be contingent on the
granting of the appeal to extend the commercial use to the entire propert
which is before the Council today.
