09-1033Susaension 9/16/2009 Council File # 09-1033 Green Sheet # 3080216 Presented 1 2 3 4 WIIEREAS, ' ico & Sons LLC d/6/a D'Amico and Sons, located at 975 Grand Avenue in Saint Paul, has requested issuance of a liquor outdoor service area (sidewalk cafe) license; and WFIEREAS, the Summit Hill Association, has a�eed to the issuance of the license; and WHEREAS, thirty-nine (39) residential properties are within a 300 foot radius of licensee's proposed patio, and licensee has obtained consent from twenry-five (25) of those properties (62%); and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WI�REAS, licensee went door to door, sent out two separate mailings and sent out mailings to residents who had not yet been contacted to obtain signatures from the remaining residences but was una6le to contact them and received no negative responses to the request for consent; and WI�REAS, the Council finds that these efforts constitute a good faith effort to fulfill all petition requirements, and that the results of the attempts to obtain signatures showed a generaily favorable disposition from the surrounding community towazd the proposed licensed activity; and WI�,REAS, the Council finds that issuance of the license will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals and general welfare of the community; and WHEREAS, the Council fmds that the application is in order and there are no grounds for denial of the license and that the failure to the license would cause exceptional and unusual hardship to the license applicant; and WIIEREAS, the notice was provided to neighboring properties within 300 feet and the district council and no objections have been received in forty-five (45) days; now, therefore, be it, RESOLVED, that a liquar outdoor service area (sidewalk cafe) license is issued to D'Amico & Sons LLC d/b/a D'Amico & Sons, located at 975 Grand Avenue in Saint Paul, subject to the agreement stated above. Kellogg Blvd, Telephone 65�-222-1222 Saint Paul, IVlinnesota 55102 Fa�c ssi-222-issa wwws u mmith illassociatio n.org RE: D'Amico & Sons - 975 Grand Ave: Li uor-Outdoor Senrice Area- Sidewa summithillC�visi.com q ( �C� �cense Dear Ms. Moermond: The Zoning and Land Use Committee (ZLU) of the Summit Hill Association {SHA)/District 16 Planning Council held a neighborhood public hearing on August 26, 2009 and met with restaurant managers Sarah Paul and Amy Britton, to review a license appfication submitted to the City by D'Amico & Sons Restaurant, requesting the Gity replace the existing Sidewatk Cafe ticense with a Liquor-Outdoor Service Area (Sidewalk) 6cense to permit extension of W.ine and Beer service onto the existing sidewalk cafe seating area. This iicense, if approved, would be added to the existing Wine On Sale, Maft On Sale tStrong), and Restaurant (4) - 51 to 150 Seats license. The Zoning and Land Use Gommittee had solicited input from the surrounding neighbors. Prior to the hearing, SHA received no comments from Iocal residents, either for or againstthe application. There was a short discussion with the applicants regarding fhe [icense application. A question was raised about how the restaurant would deal with beer left on sidewalk iables by departing customer unattended. The Committee was satisfied with the response of Ms. Paui, that D'Amico wait staff would be watching and that each year ihe resfaurant sends staff as�d managers to training for winelbeer serving and ID's. Based on this testimony and lack of prior complaints or neighborhood opposition, the ZLU Committee entertained a motion that was approved unanimously (5 - 0) recommending that the city approve this Gcense application. Fallowing that vote, another motion was made to recammend waiving the 45-day waiting period for the license.
