RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and directed to prepare plans and specifications for said improvement, and submit same to the Council for approval; that upon said approval, the proper city officials are hereby authorized and directed to pro- ceed with the making of said improvement in accordance therewith. HOLMGREN, Deputy Commissioner 234 City Hall & Court House qqp.g May 4, 1959 Dear Petitioner: Because the resurfacing of Como Avenue from Snelling to Hamline Avenues is under the jurisdiction of the Department of Public Works, the City Council re- ferred your petition concerning this project to the Department of Public Works for reply. As you know, Mr. George Shepard, the present Street and Highway Coordinator for the City of Saint Paul, was City Engineer for over thirty years, and he is completely familiar with the proposed improvement of Snelling Avenue in the neighborhood of the Great Northern and Northern Pacific tracks and Como Avenue. On the basis of legislation enacted in the present session of the Legislature, it appears quite certain at this time that the State Department of Highways will proceed with the Snelling Avenue project as it pertains to the Great Northern and Northern Pacific Railroad track area. However, it is not at all certain if the project will be extended to include an overpass of Como Avenue at Snelling. Even if such an overpass is included in the project, Mr. Shepard informs me that such an overpass would not in any way alter or change the present width, grade, or surfacing of Como Avenue. The overpass would only involve changing the grade of Snelling Avenue and the possible widening of this Avenue. If such widening on Snelling Avenue proved to be necessary, Mr. Shepard informs me it would affect the west side of Snelling Avenue only, thus having no affect on Como Avenue east of Snelling Avenue. I mention these facts to reassure you that the project would have no disadvantageous affects on the resurfaced portion of Como Avenue, as stated in reasons one and two of your petition. In reason three of your petition, you refer to a more clear definition of the phrase contained in the order, "by doing all other work necessary and inciden- tal to complete said improvement ", and you express the thought that such work might increase the estimated cost per front foot. This phrase has been contained in Public Works orders of this type for many, many years, on advice of the City Attorney's Office. It does not in any way authorize the Department of Public Works to do any work beyond the basic project as described in the Council order. Of more importance to you, however, is the fact that such work can in no way ,ffect the estimated cost per front foot as far as you, as a property owner., are concerned. In an order of this kind, any costs over and above those originally estimated, must be absorbed by the City and cannot be added to the front foot cost of the property owner. In this respect, I can give you absolute assurance that there will be no change in your front foot assessment. Such increases occur only in the case of projects which are paid for entirely by the property .. - May 4, 1959 owner. In projects such as Como Avenue, which are financed primarily by the City, any additional costs which are encountered must be absorbed by the City and not by the individual property owners. In reason four, you state the thought that the new surfacing on Como Avenue will deteriorate to the point where it will be necessary to replace it before alternate truck routes are established. There are two facts in this case which should be considered. First, under the provisions of the City Charter, after a property owner has been assessed for street improvement work, he or she cannot be similarly assessed for similar work for fifteen years. In other words, the City would be obligated to maintain the new pavement, and you would be immune from assessment for any such costs. Secondly, the fact is that alternate truck routes will be established long before the new paving on Como Avenue will deteriorate.' The Northern Route, which will run parallel with the Great Northern tracks, and which will connect the Midway and St. Anthony Park areas with the Dale Street, Rice Street, and Capital areas, will be completed by the end of next year. In addition, the St. Anthony -Rondo Avenue leg of the interstate freeway system will be completed long before there will be any serious deteriora- tion in pavement laid at this time. Finally,, let me conclude by stating that this project is one of the many street improvement projects which were authorized by the voters of the City of Saint Paul in the 1953 United Improvement Program. This program was approved by the citizens of Saint Paul on the basis of the belief that, if the City was to survive, the progressive deterioration which took place during the depression years and the war period had to be stopped. By approving the program in 1953, we, as citizens of Saint Paul, in effect, made the decision that our jobs, our businesses, and our ability to stay.in Saint Paul and live in our homes as families, depended, in part at least, on reversing the trend of deterioration which seemed to prevail throughout most of the City. Most of the street improve- ments, with which you are familiar, were accomplished under this program. They were all financed. in the .same manner in which it is proposed to finance this project, namely, by having all of the citizens of the City assume the major portion of the cost through the United Improvement Program. The City Council instructed me to inform you that it will be impossible to conduct an evening hearing, as you request, for two reasons. The first reason is the fact that the City Charter specifies that official Council meetings shall be at 10 A.M. in the morning, and the other reason is the fact that, because of the many and diverse commitments of the various members of the Council, it is virtually impossible for most of the members of the Council to be available on any given evening.
