RESOLVED, that upon appeal of the Oakland Company
from the decision of the Commissioner of Parks, Playgrounds

and Public Buildings, the side yard buffer requirement is
established as three feet on both the easterly and westerly
sides of Lot 8 and Lot 10, Block 12, Terrace Park Addition,
located on the north side of Oakland Avenue between
Western and Lawton Avenues, in conjunction with the installation
and operation of a parking lot thereon, accessory to 2 eleven

The City Council requested that you prepare a resolution granting the application of
the Oakland Co. for permit to install and operate two private parking lots accessory
to two ebren unit apartment buildings on Lots 8 and 10, Block 12, Terrace Park Addition,
on the north side of Oakland Ave. between Western and Lawton Aves.
The Council also requested that you prep"p_a resolution granting the appeal of
The Oakland Co. for the relaxation of the street parking lot requirements on
Lots 8 and 10, Block 12, Terrace Park Addition, located on the north side of Oakland
between Western and Lawton, as more fully described in the attached letter of the

Dear Sir:
This is in the matter of the application of the Oakland Company to, install
and operate two private parking lots accessory to two eleven unit apartment
buildings, and an appeal to relax the side yard requirements of both sides
of each lot, on property located on the north side of Oakland Avenue-between
Western and Lawton .Avenues. The legal description is Lot 8 and 10, Block 12,
Terrace Park Addition. The zoning is t1V Residence and has been since the
adoption of the ordinance in 1922.
Each lot has a frontage of 60 feet along Oakland Avenue, Lot 10, the westerly
one, has an average depth of approximately 198 feet, producing an area of
approximately 12,000 square feet. Lot 8, on the east, has a frontage of 60 .
feet with an average depth of 217 feet, producing an area of approximately
13,000,square feet. The applicant proposes that each lot will be the site of
an eleven car parking lot and an eleven unit apartment building.
The adjacent land uses are as follows: Lot 9, which lies between the two
lots under consideration, is developed with a large two and one -half story
frame multi - family residence; east and adjoining Lot 8 is a large two story
frame multiple residence; west and adjoining Lot 10 is a two-story-frame
residence; south across Oakland and Pleasant Avenues are single family
residences which front on Pleasant Avenue and which will eventually be re-
moved for the right -of -way needs of the Pleasant Avenue Freeway; north and
adjoining at the top of the bluff are residences which front on Summit Court.
Field investigation reveals that the terrain of Lot 10 is level and slightly
above the Oakland Avenue Street grade to a depth of about 140 feet; Lot 8 is
also level and slightly above street grade to a depth of approximately 1251.
The remaining portion of each of these lots beyond this depth is a very steep
rocky slope. In order to level sufficient area toward the rear of each lot
for adequate off - street parking spaces, the base of this slope will have to
be cut, possibly making it necessary to construct retaining walls. Should
this prove necessary, the applicant has agreed to construct the necessary
retaining walls as directed by the City Architect, and has so stated on his
plan.
The traffic engineer has approved the layout of the parking lot plans which
meet standards for this type of facility except for the change in the side
yard buffer. Field investigation further discloses that the only possible
means of providing adequate space for the installation of.the parking lot
would -be in relaxing the 8 foot yard buffer to,three feet.

In consideration of the above factors, the Board of Zoning recommends the
granting of the appeal to relax the side yard buffer from eight feet to three
feet on both the easterly and westerly sides of both Lots 8 and 10, and the
permit for the construction and operation of an 11 car private parking lot on
each of the afore mentioned lots, in accordance with plans approved March 5,
1959.

Appeal from the Zoning Code, of the Oakland Company,
for relaxation of the off - street parking lot require-
ments on Lots 8 and 10, Block 12, Terrace Park Addition
(located on the north side of Oakland Ave. between
Western and Lawton)
and
Application of the Oakland Company for permit to erect
two 11 -car private parking lots in connection with
two proposed 11 -unit apartment buildings on the north
side of Oakland Avenue between Western and Lawton
Avenues (property described as Lot 8, Block 12, and
Lot 10, Block 12, Terrace Park Addition);
and that public hearings will be held at 10 :00 a.m. on April 16,
1959 in the Council Chambers of the Court House and City Hall in
the City of St. Paul.
