WHEREAS, the Metropolitan �

Requested by Department of:
iry of Saiat Paul entered into a Cooperadve Construction and Utility Relocation Agreement
, deslgn, scheduling, funding, conshucfion, and quality oversight issues related to the Advance
project; and
WI the Me�opolitan Council ac(mowledges and agrees that, with ihe sole exception of the brick pavers for which the Ciry will
reimbux�e the Mehopolitan Council, the Advance Ufility Relocarion addressed in the agreement is directly attributable to the CCLRT project,
that it does not constitute upgrading of the facili5es and that it provides no increase in value of the Utilifies or the Relocated Faciliries, thus,
the Mehopolitan Council shall reimburse City for all actual, allowable, allocable and reasonable costs associated with the U[ility Relocarion;
and
WHEREAS, the cost share agreement is not [o exceed $315,900; and
WFIERAS, a budget must be established including both ependiog and &nancing line itams; so
THEREFORE BE IT RESOLVED, by the Council of the City of Saint Pau1, upon recommendation of the Mayor and advice of the Long
Range Capital Improvement Budget Committee, that $315,900 is available for appropriation in the 2009 Capital Improvemeni Budget, as
heretofore adopted and amended by this Council, be hereby further amended in the Improvement Budgets, in the following particulars:

The Metropolitan Councii and the City of Saint Paul entered imo a Cooperative Construc6on and Utility Relocarion Agreement per
Council Resolufion 09-527 to address titning, design, scheduling, fiutding, conshuction, and quality oversight issues related to the
Advance Utility Relocafion to avoid delaying the Metropolitan Council CCLRT Project expected to commence in 2010.

The cost shaze agreement funding from the Metropolitan Council will be included in the 2009 Capital Improvement Progam Budget
to be used to finance this utiliry relocation project

Disadvantages If Not Approved:
The cost shaze agreement with the Metropolitan Councii will not be reflected in the 2009 Capital Improvement Program budget and
there will be insufficient budget to pay for the relocation of the utiliries as required for Metropolitan Council CCLRT project.

Attached is a budget resolution that would establish a spending and financing plan for the
4` Street LRT Utility Relocation project. The work will be done on 4`" Street between
Minnesota and Broadway. It will be paid for by the Metropolitan Council per a Council-
adopted cost sharing agreement. OK to sign.
