09-1016Council File # � ��Q�(fl Green Sheet# 3077976 RESOLUTION OF Presented PAUL, MINNESOTA - !f� -- 1 BE IT RESOLVED, that, upon the petition of the Metropolitan Council ("Peritioner") as 2 documented in Office of Financial Services Vacation File Number OS-2009, the public property 3 described in the attached E�ibit A is hereby vacated and discontinued as public property and, subject 4 to the following conditions, the easements within said public property are hereby released: 5 6 1. An easement shall be retained on, over and across the vacated area on behalf of the Board of 7 Water Commissioners of the City of Saint Paul to reserve the right of the Board to maintain 8 and operate any water facility in or upon said easement, and to enter upon said easement, or 9 any portion thereof, at any time and from time to time for the purposes of future construction, 10 11 12 13 14 15 16 17 18 l9 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 reconstruction, inspection, maintenance or repair of the same, or any part thereof. Said easement shall be subject to the following requirements: a. No buildings, shuctures, trees or any temporary structure, material storage, fixture, or any other objects which may prohibit normal access to water facilities for maintenance purposes will be permitted within the easement area. b. Improvements in or upon the above described easement that do not prohibit the Board from exercising it reserved rights may be allowed by obtaining written permission from Saint Paul Kegional Water Services with the understanding that the restoration and costs of such improvements shall be the sole responsibility of the petitioner, its successars and assigns in the event the Board exercises its reserved easement rights. c. Should it be necessary that the petitioner's works or improvements be removed or damaged as a result of Saint Paul Regional Water Services operations, all removal, replacement or modification costs sha11 be borne solely by the petirioner. d. No change from the existing grade within the easement azea shall be permitted without written permission from Saint Paul Regional Water Services. e. No change in surfacing within the easement area shall be perxnitted without cvritten pernxission from Saint Paul Regional Water Services. £ The petitioner, its successors and assigns sha11 fully indemnify, defend, and save harmless the Board of Water Commissioners of the City of Saint Paul, its officers, agents, employees, and servants from a11 suits, actions or clauns which shall arise from any injuries or damages received or sustained by any break in any service pipe, water main, or connection in said reserved easement, arising out of or resulting from any action or negligence of the petitioner, its employees, agents or business invitees. 2. An easement shall be retained on behalf of Comcast for its existing facilities. This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended. 4. The petitioner, its successors and assigns shall pay $600.00 to the City of Saint Paul as an adniinistrative fee for this vacation which is due and payable within 60 days of the effective date of this resolution. 5. The petitioner, its successars and assigns shall, within 60 days of the effective date of this resolution, file with the Office of Financial Services/Real Estate Section, an acceptance in writing of the conditions of this resolution and shall, within the period specified in the terms and conditions of this resolution, comply in all respects with these terms and conditions. 6. The petitioner, its successors and assigns agree to indemnify, defend and save harmless the City of Saint Paul, its officers and employees from all suits, actions or claims of any character brought as a result of injuries or damages received or sustained by any person, persons or property on account of this vacation, or the petitioner's use of this property, including but not limited to, a claim brought because of any act of omission, neglect, or misconduct of said petirioners or because of any claims or liability arising from any violation of any law or regulation made in accardance with the law, whether by the petitioner or any of its agents or employees. I request this vacation for the following reasons: Petitioner, a duly organized public corporation and political subdivSsion of the State of Minnesota, has acquired the above described real property by eminent domain for the purpose of ingress and egress, constructing, improving, and replacing a 1ift station, sanitary sewer pipes, and related facilities and utility improvements for the Lift Station L-12 Improvement Project. Attached hereto as Exhibit A is a true and correct copy of the Fina1 Certificate showing Petitioner's acquisition of the above described real property. Petitioner's request for vacation is in the public interest, and no portion of the alley to be vacated terminates, abuts, or is adjacent to any public water. No signatures of other owners are required, as Petitioner owns all properties abutting the portion of the alley to be vacated. The portion of the alley to be vacated was previously subject to a highway easement in favor of the State of Minnesota. 3. I have attached as Exhibit B six copies of the development intended for construction on the lands to be vacated. The proposed development will not alter the grade.
