1 BE IT RESOLVED, that, upon the petition of the Metropolitan Council ("Peritioner") as
2 documented in Office of Financial Services Vacation File Number OS-2009, the public property
3 described in the attached E�ibit A is hereby vacated and discontinued as public property and, subject
4 to the following conditions, the easements within said public property are hereby released:

6 1. An easement shall be retained on, over and across the vacated area on behalf of the Board of
7 Water Commissioners of the City of Saint Paul to reserve the right of the Board to maintain
8 and operate any water facility in or upon said easement, and to enter upon said easement, or
9 any portion thereof, at any time and from time to time for the purposes of future construction,

reconstruction, inspection, maintenance or repair of the same, or any part thereof. Said
easement shall be subject to the following requirements:
a. No buildings, shuctures, trees or any temporary structure, material storage, fixture,
or any other objects which may prohibit normal access to water facilities for
maintenance purposes will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the
Board from exercising it reserved rights may be allowed by obtaining written
permission from Saint Paul Kegional Water Services with the understanding that the
restoration and costs of such improvements shall be the sole responsibility of the
petitioner, its successars and assigns in the event the Board exercises its reserved
easement rights.
c. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs sha11 be borne solely by the petirioner.
d. No change from the existing grade within the easement azea shall be permitted
without written permission from Saint Paul Regional Water Services.
e. No change in surfacing within the easement area shall be perxnitted without cvritten
pernxission from Saint Paul Regional Water Services.
£ The petitioner, its successors and assigns sha11 fully indemnify, defend, and save
harmless the Board of Water Commissioners of the City of Saint Paul, its officers,
agents, employees, and servants from a11 suits, actions or clauns which shall arise
from any injuries or damages received or sustained by any break in any service pipe,
water main, or connection in said reserved easement, arising out of or resulting from
any action or negligence of the petitioner, its employees, agents or business invitees.
2. An easement shall be retained on behalf of Comcast for its existing facilities. If relocation of
the facilities is required, the petitioner, its successors or assigns, sha11 assume all costs of

relocation and shall provide new easements for said relocated facilities.
3. This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1,
1981, of the Saint Paul Legislative Code as amended.
4. The petitioner, its successors and assigns shall pay $600.00 to the City of Saint Paul as an
adniinistrative fee for this vacation which is due and payable within 60 days of the effective
date of this resolution.
5. The petitioner, its successars and assigns shall, within 60 days of the effective date of this
resolution, file with the Office of Financial Services/Real Estate Section, an acceptance in
writing of the conditions of this resolution and shall, within the period specified in the terms
and conditions of this resolution, comply in all respects with these terms and conditions.
6. The petitioner, its successors and assigns agree to indemnify, defend and save harmless the
City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation, or the petitioner's use of this property, including but not
limited to, a claim brought because of any act of omission, neglect, or misconduct of said
petirioners or because of any claims or liability arising from any violation of any law or
regulation made in accardance with the law, whether by the petitioner or any of its agents or
employees.

The Metropolitan Council Environmental Services, wlilch owns the properry on wlrich is located the platted alley, plans to construct a
sanitary sewer lift station and wishes to vacate all other public interest in the proper[y. Vacation will allow the lift station to be
constructed.
Advantages If Approved:
The vacation will allow the METC to construct the sanitary sewer lift. It caanot do so over platted alley right-of-way.
Disadvantages If Approved:
None. This properry has been used as swplus state highway right-of-way for many yeazs. The platted alley has not opened or used
by the public.
Disadvanqges If Noi Approved:
If the vacation is not approved, the METC will be unable to conshuct the sanitazy sewer IiR station on land it owns.

1. I, Thomas Weaver, the undersigned Regional Administrator for Petitioner Metropolitan
Council, constituting the sole owner of all of the abutting properties, do hereby petition
the Council of the City of Saint Paui to vacate its interests in that part of the alley lying
within the following described property: That part of Block 1, Valentines Addition to
Burlington HeigJits, Ramsey County, Minnesota, described as follows:
Commencing at the southwest corner of Lot 15, Block 6,
Burlington Heights, Division No. 2, Ramsey Co., Minn.; thence on
an assumed bearing of North 21 degrees 36 minutes 29 seconds
West, along the West line of said Block b, a distance of 246.41
feet; thence South 68 degrees 23 minutes 31 seconds West 66.00
feet to the East line of said Block l, Valentines Addition, and the
point of beginning of said property to be described; thence South
65 degrees 5 minutes 28 seconds West 100.33 feet; thence South
24 degrees 54 minutes 32 seconds East 121.61 feet; thence North
65 degrees 5 minutes 26 seconds East 93.32 feet to said East line
of Block 1; thence northerly along said East line to the point of
beginning, and there terminating.
2. I request this vacation for the following reasons: Petitioner, a duly organized public
corporation and political subdivSsion of the State of Minnesota, has acquired the above
described real property by eminent domain for the purpose of ingress and egress,
constructing, improving, and replacing a 1ift station, sanitary sewer pipes, and related
facilities and utility improvements for the Lift Station L-12 Improvement Project.
Attached hereto as Exhibit A is a true and correct copy of the Fina1 Certificate showing
Petitioner's acquisition of the above described real property. Petitioner's request for
vacation is in the public interest, and no portion of the alley to be vacated terminates,
abuts, or is adjacent to any public water. No signatures of other owners are required, as
Petitioner owns all properties abutting the portion of the alley to be vacated. The portion
of the alley to be vacated was previously subject to a highway easement in favor of the
State of Minnesota.
3. I have attached as Exhibit B six copies of the development intended for construction on
the lands to be vacated. The proposed development will not alter the grade. The
proposed development will constitute a permanent structure.

Attached are a Reply to Vacation Inquiry form and Maps related to a petition by the Metropolitan Council to vacate a portion
of a platted alley formerly in MnDOT right-of-way. In March, 2009 the Metropolitan Council acquired a permanent easement
over a rectangular area south of Lower Afton Road for the construction a�d operation of a sanitary sewer lift station. The
Council wishes to vacate the underlying platted alley within this area to clean up title.
Piease review this request and return the completed Inquiry Reply Form to me via email or US mail. I would
appreciate receivingit by Thursday, ]uly 2nd. If you have any questions or concerns, feel free to reply by email or call me

I recommend a public hearing before the City Council be held on September 16,
2009 to consider the petition of the Metropolitan Council to vacate the platted a11ey
in Block 1, Valentine's Addition, adjoining Point Douglas Road east ofUS Hwy 61
and south of I,ower Afton Road.
The purpose of this vacation is to remove an unnecessary right-of-way easement
rights within a parcel owned by the Metropolitan Council and used for a proposed
sewer lift station.
This property is located in City Council Ward 7, Planning District 1.
