An ordinance amending the Zoning Code, Chapters
60 to 64 inclusive off, the Saint Paul Leg. slative
Code, pertaining to Use Districts, Height Dis-
tricts and Rezoning of certain properties -in the
City of Saint Paul, as amended. This is an
emergency ordinance rendered necessary for tle
preservation of the public peace, health and
safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code,'Chapers 60 to 64
inclpsive of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain
properties in the City of Saint Paul, as amended, be and the
same is hereby further amended so as to rezone the following
described property from "All Residence District to Commercial
District:
Lots 4 and 5, Block 1, H. JurgensenY's :Addition,
according to the plat thereof on file and of
record in the office of the Register of Deeds
in and for Ramsey County, Minnesota, located at
the northwest corner of Nebraska and Hamline
Av ,anues, subject to the following express exceptions
and cordtions:

1. That, subject to any further reclassification of the
hereinabove described real estate by virtue of proceedings
therefor hereafter instituted, conducted and completed according
to applicable provisions of said Zoning Code, as amended, and
applicable provisions of the statutes of the State of Minnesota,
hereby, the employment,of said real estate henceforth is restricted
and limited to the following specified uses, to -wit:
a. Residential District uses_- permitted by

Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

This is in the matter of Frank Jannett's application for an amendment to the
Zoning Code to rezone from "Alt-"Residence to ttCommercial't, certain property
located at the northwest corner of. Nebraska and Hamlin. The legal descrip-
tion is: Lots 4 and 5, Block 1, H. Jurgensen's Addition. Zoning of the
property is ttAtt Residence'and- has been since 1922. The Commissioner of
Finance reports that within the_prescribed 100 foot radius, nine of the
twelve owners or 75% have signed the petition.
On December 19th, 1957, the City Council denied a petition to rezone Lot 4
from IV Residence to "Commercial" for "the purpose of development of the
property "with a one -story Doctor's office building. Presently Lot 5, which
is directly adjoining the inter - section of Hamline and Nebraska Avenues, is
developed with a two -story frame building. The first floor is -.used as a
small neighborhood grocery store and barber shop, and,the second floor is
used for residential purposes. Lot 4 is vacant and undeveloped. The applicant
proposes to enlarge the present building to improve his grocery store operation
and to provide off - street parking on vacant Lot 4 which is adjoining.
The property has a frontage of 71.8 feet along Hamline Avenue and 128.35 feet
along,Nebraska Avenue producing an area of 9,200 square feet. The - adjacent
land uses are: north and adjacent single family residences fronting on Hamline
Avenue; east across Hamline Avenue, single family residences fronting on
Hamline Avenue; west and adjoining a single family home fronting on Nebraska
Avenue; south across Nebraska Avenue, a single family residences) and office
of a dentist therein which fronts on Hamline Avenue,, also a single family
residence which fronts on Sheldon Street.
The existing store on Lot 5 was built in June,1922 and is therefore a non -
confor&ayg use. Field investigation discloses that the immediate area is
developed residentially. If the petition to rezone is granted, it would
clearly be a matter of spot commercial zoning. It is the opinion of the
Board and its staff that the nonconforming use is not detrimental to the
neighborhood, but by granting a rezoning, the property could be developed with
undesirable uses which would not be in harmony with the character of the
neighborhood and not in accordance with the intent and purpose of the Zoning
Code.
In consideration of the above factors, the Board of Zoning recommends that the
petition to rezone the property under zonsideration from "All Residence to
"Commercialtt be denied.
