The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, December 17, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 665-667 BLAIR AVENUE. That the Subject Properry comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. Tha1 the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). 5. � That the deficiencies causing Yhis nuisance condirion have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in thas resolution and that the notification requirements of Chapter 45 have been fulfilled. If the above conective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this sriucture, fill the site and chazge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. According to our files, it has been a vacant building since May 10, 2007. The current property owner is Koe Yang (new owner), per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been nine (9) SUMMARY ABATEMENT NOTICES since 2007. There have been nine (9) WORK ORDERS issued for: - Boarding - Removal of improperly stored refuse and miscellaneous debris - Removal of tall grass and weeds - Removal of snow and ice On June 17, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. The new property owner of record, Koe Yang, did not appeaz. No other parties of interest appeared. Mr. Magner stated the building was a two-story, wood frame, three-unit dwelling on a lot of 4,792 squaze feet and had been vacant since May 10, 2007. A C of O team inspection had been done on May 27, 2008, the vacant building registration fees in the amount of $1,000 were paid by assessment, and the $5,000 performance bond was posted on November 12, 2008. On June 17, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on June 30, 2008 with a compliance date of July 30, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation estimated the market value of the land to be approximately $35,700 and the building to be $159,500. Real estate tases were current. Code Enforcement estimates the cost to repair the building to be approximately $100,000 to $125,000. The cost for demolition was estimated to be approximately $15,500 to $20,550. There had also been nine summazy abatements issued to this property since 2007, nine of which went to work order: to secure the building and the City had to boazd the building to secure it from trespass, remove improperly stored refuse and miscellaneous debris, boazding, cut tall grass and weeds, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1889 and was a Queen Amme-style building. She noted that the exterior had been stuccoed and overall lacked integrity. The original building also was not built with a porch; however, an upper and lower porch had been added at some point in time. She did not believe demolition would have a adverse effect on the neighborhood. (Laid over from November 25) Koe Yang, property owner and Chad Lemmons, realtor, appeared. Mr. Lemmons stated that Mr. Yang had recently purchased the property and had not received knowledge of the previous hearing. As a result, he did not have a work plan with timelines or bids from subcontractors. Mr. Yang anticipated he would have the rehab completed within 60 days. Ms. Moermond asked Mr. Yang about his financial ability to rehabilitate the building. Mr. Yang responded that he had not applied for any financial assistance and was using his savings, approximately $50,000, to fund the project. Mr. Lemmons responded that Mr. Yang was doing all of the work himself with the exception of the trade work which was being subcontracted. Ms. Moermond stated that she was skeptical about Mr. Yang successfully completing the rehab of the property given the amount of funding that was required. She asked Mr. Yang whether he had completed rehabilitations to other properties in the City. Mr. Yng responded that he had done other projects; however, he did not renew his general contractor license with the state because of the decline in the economy. Mr. Magner reviewed the file and asked Mr. Yang whether he had received a summary abatement order to remove a mattress, bags of trash and debris. Mr. Yang responded that he did. Mr. Magner stated that the property was re-inspected on December 8 and was found to not be in compliance. A work order was sent to the Parks Department who would be at the property that day to do the clean up. He suggested to Mr. Yang that when he left the hearing, he should immediately go to the property on Blair to remove whatever was there before the City did the work and there was an assessment against the property for the clean up. He lectured Mr. Yang on his responsibility to manage his property. Ms. Moermond expressed concern with the nuxnber of sumuiary abatement orders issued to the property and it appeazed that the City had been managing the property for the owner. She recommended continuing the Legislative Heazing to December 23 in order for the owner to provide the following: 1) a work plan with timelines; 2) contractor bids; 3) financial documentation outlining the funds available to do the rehab; and 4) the property must be maintained. She would then recommend continuing the Council Public Hearing to January 7. December 23, 2008 Legislative Hearing Minutes �� ��� � Page 2 Ordering the owner to remove or repair the building(s) at 665-667 Blair Avenue within fifteen (15) days from adoption of resolution. (Original hearing on November 25; continued to December 9 and December 23) Koe Yang, property owner, appeared with his attorney, Joseph Kelly. Mr. Yang said that he had sent a work plan and supporting documentation via faac the previous evening. Ms. Moermond responded that neither she nor Mr. Magner had the opportunity to review the documents prior to the hearing. Ms. Moermond stated that at the previous hearing, there was a work order that had been issued to clean up the property. She asked Mr. Magner whether the property was being maintained. Mr. Magner responded that he indicated to Mr. Yang that a summary abatement order had been issued which resulted in a work order and that it was in his best interest to go to the property after the hearing to do the clean up before the City crew arrived. According to the file, the inspector had not re-inspected the property since the last hearing. Ms. Moermond stated that in reviewing the work plan, the cost of the repair was listed as $39,000 which appeared to be a substantial discrepancy between the estimated $100,000 which the department was estimating. In reviewing the financial documentation that was submitted, it did not appeaz that Mr. Yang had adequate funding to afford the cost of the rehab. Mr. Kelly stated that Mr. Yang had two separate bank accounts; one account had $20,000 and the other account had approximately $22,000 which would be used to pay for the rehab. Ms. Moermond stated that she would need an affidavit from Mr. Yang dedicating the funds in these two accounts for the rehabilitation of this property. After the hearing, Ms. Moermond and Mr. Magner reviewed the documents that Mr. Yang had presented at the hearing. Mr. Magner stated that he was concerned with the work plan as it only listed the cost of materials and the labor costs were not included. He was also concerned as to whether Mr. Yang was a licensed contractor with the State of Minnesota. Ms. Moermond asked Ms. Vang to send a letter requesting the following: 1) provide proof that Mr. Yang has a general contractor's license; 2) provide wark plan which includes labor costs or total cost of the rehab; and 3) provide an affidavit dedicating funding for this project.
