materials or rubble, tires, brush, etc., from yard areas, including scrap wood, pots, trash
on the stairs to the 2" level, and pots, yard waste, bricks, tree limbs scrap

3. Appeal of Richard Miller to a Summary Abatement Order for
Richard Miller, appellant appeared.

Ms. Seeley stated that a complaint was received on June 30 that there were buckets, construction
debris, bricks, in the enclosed outside stairway as well as the yazd, and that the building had
possibly been vacant for over one year. The property was inspected on July 8 and a suuunary
abatement order was issued to remove scrap wood, pots, and trash on the stairs as well as to remove
pots, yard waste, bricks tree lunbs, scrap wood, and trash in the back yard. The inspector also
included the ordinances concerning boulevazd pianting and composting. The compliance date was
July 21 and the owner filed an appeal requesting additional time. She had inspected the property
that morning and found it to be in compliance with the exception of the bricks.
Mr. Miller stated that he had filed the appeal to preserve his property rights and he also wanted to
meet with the inspector at the hearing. He wanted to keep the bricks so he could use them as
supports for a deck that he intended to build the following spring.
Ms. Moermond asked whether he had a shed ar garage that he could store them in. Mr. Miller
responded that he had a garage; however, it was full and he didn't haue room for the bricks.
Ms. Moermond asked Ms. Seeley if she would agree that he could keep the bricks neatly stacked
outside until the following spring. Ms. Seeley responded that this would be okay and that if another
complaint was received, they would have to deal with the issue then.
Ms. Moermond recommended denying the appeal and granting an extension on the exterior bricks
to June 30, 2009.
