THE COUNCIL OF THE CITY OF S.A INT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64
inclusive, of the Saint Paul Legislative Code, pertaining to
Use Districts, Height Districts and Rezoning of certain
properties in the City of Saint Paul, as amended, be and the
same is hereby further amended so as to rezone the following
described property from "A" Residence District to Commercial
District:
The North one -half of Hoyt Avenue vacated,
adjoining Lot 6, Block 3, Ufton Grove Third
plat (located on Payne Avenue and Parkway
Drive, at Hoyt Avenue).
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.

Gentlemen:
I hereby respectfully petition the City Council of the
City of St. Paul to re -zone the above mentioned property from "A Resi-
dential" to "Commerciale. (Adjoining property on the south is now
zoned commercial). Arrangements could then be made to build-new facil-
ities to replace the er sent building, which was built in 1926. The
addition of this property wo ena�3�e us to construct afar more attrac-
tive building than would otherwise be possible, and one which will greatly
enhance the appearance of the surrounding neighborhood.

This is in the matter of the application of Robert Swanson for rezoning the north
one -half of Hoyt Avenue,'vacated, adjoining Lot 6, Block 3, Ufton Grove Third Plat
(located on Payne Avenue and Parkway Drive, at Hoyt Avenue) from "A" Residence to
commercial. The zoning is "A" Residence, and has been since 1922.
On November 20, 1958, the Commissioner of Finance reported the petition sufficient
with nine out of the eleven owners of land within a 100 foot radius of,the property
signing the petition.
The property under consideration is the north half of vacated Hoyt Avenue between
Payne Avenue and Parkway Drive. This portion, together with the south half of Hoyt
Avenue was vacated by Council action on September 28, 1932. The vacated portion of
Hoyt-Avenue under consideration is presently vacant and undeveloped. The purpose
of this rezoning is to extend the commercial zone to enable the applicant to integrate
this property with the property adjoining to the south. The property to the south is
presently developed with a filling station, but said operation was abandoned in
July 1957. If the rezoningis granted, the applicant proposes to remove the present
station and to construct a drive -in laundry and dry cleaning pick -up store. The
present development of this site, including the abandoned filling station, leaves
much to be desired from a site plan and traffic point of view. The proposed develop-
ment of the property together with the vacated north half of vacated Hoyt Avenue
would be an improver;ent over the existing development.
The property under consideration for rezoning takes on the shape of a trapezoid
having a frontage of 30 feet along Payne Avenue, and about 39 feet along Parkway
Drive. This tract, together with the property directly adjoining on the south be-
comes triangular in shape and has a frontage of 101 feet along Payne Avenue, 141.7
feet along Parkway Drive, and 89.5 feet along the north property line, thus produc-
ing a site area of approximately 4,520 square feet.
The adjacent land uses are as follows: north and adjoining is a single family resi-
dence built in 1916; west and across Payne Avenue is Brinks Supermarket and Hoyt
Avenue; east across Parkway Drive is Hoyt Avenue with single family residences
fronting thereon, and also Parkway Drive; south across Parkway Drive is a single
family residence fronting on Parkway Drive; a Shell Oil service station is 'located
on one corner of this intersection.
Field investigation discloses that sidewalks exist along both Payne Avenue and
Parkway Drive. The Traffic Engineer has•reviewed applicant's plans and in a
letter dated December 10i, 1958 signifies approval of the plan.
