Appeal of Paul Marcuson to a Vacant Buildin Re � � --- - Paul Marcuson, property owner, appeared. Ms. Shaff stated that Inspector Stevens found that the property had been winterized and was vacant. He then transferred the file to the Vacant Building's Program. Mr. Senry stated that the vacant building file was opened on Apri17, 2008 as a category 2 and placards were placed on the front and the back of the buiiding. At that time, the property was in foreclosure and the notice was sent to Wells Fargo. Mr. Marcuson stated that he had purchased the house on May 25, 2408 and did not know that it was considered a vacant building as the bank never told him at the time of closing. He believed that the bank should have to pay the vacant building fee. He said that when he bought the property, the house was absolutely filthy and the copper had been stolen. He claimed he was working on the house every day to make all of the repairs. Ms. Moermond stated that Wells Fargo should have disclosed that this was a vacant building and a code compliance inspection should have been done as opposed to a TISH report. He would be required to have a code compliance inspection done and bring everything up to code before the building could be occupied. She asked whether he saw the placards on the building. Mr. Marcuson responded that he did and had removed them. Ms. Moermond responded that this was his notification and if he had read the placards, he would have noticed that it was a misdemeanar to remove the signs. Mr. Mazcuson stated that his brother was operating a business out of the npstairs unit. Ms. Moermond stated that his brother could not occupy the upstairs unit until the building was brougj�t into compliance. She also suggested he hire an attorney since the bank failed to disclose the vacant building status at the time he purchased the property. She recommended denying the appeal and waiving the vacant building fees in the amount of $250 for 90 days.
