WHEREAS, upon the petition of Terry Miller for Land Capital Group, as documented in Public
Works Technical Services, Vacation File Number 04-2007, the public property hereinafter
described, as follows and on attached map Eghibit A, was hereby vacated of its interest as
sneet right-of-way as approved by City Council as Council File 07-809, Eahibit B, on September
19, 2007 and approved by the Mayor on September 25, 2007; and
WI�EREAS the petitioner has not complied with terms of the resolution after repeated
notifications of same, namely,
"That the petitioners, their successors and assigns shall pay $1200.00 as an
administrative fee for this vacation which is due and payable within 60 days of the
effective date of this resolution," therefore
BE IT RESOLVED that, said vacation and ali of its terms and conditions shall be,
immediately upon approval of this resolution, rescinded.

2_ That an easement shall be retained on behalf of Northem States Power Comgany dba Xcel
(Eleciric), a Minnesota Corporation, for its e�sting facilities. The petitioner or its
successor shali provide new easements if required and the petitioner or its successor shall
assume ali costs of relocating facilifies to the new easements.
3. That the petitioners, their successors and assigns shall, within 60 days of the effechve date
of this resolution, file with Public Works, City Real Estate, an acceptance in writing of the
conditions of Yhis resolution and shall, within the period specified in the terms and
conditions of tlus resolution, comply in al] respects with these terms and condirions.
